Unfair default

Hi all

In Aug 2013 I called up my credit card provider( opus ) to ask them to if they could reduce payments on my credit card account as I was unwell and would be off work for a year, about two weeks later I got a letter from them stating that the remainder of my balance had been written off and they now considered my account closed and will not be pursuing me for the debt.
I never asked ask them to do this but was extremely grateful although a bit surprised any ways 3 years down the line I checked my credit file and see they have actually defaulted me, I called them to ask them if they could remove the default but they refused saying the debt was not written off,they just decided not to collect it
I stated to the operator that I had a letter stating clearly that the debt was written off and the account closed however he was unable to help any further is there anyway I can get this default removed from file as it shows that I owe £2000

    Unlikely that you would get the default removed. If you need credit (and wouldn't advise it) then you could come to an arrangement to pay off the debt. A satisfied default looks better than a default.

    If you don't need credit in the next few years and they definitely won't pursue the debt, then I wouldn't do anything and just wait till the default drops off.

    It's a true correct default, yes you were I'll and unable to work but still defaulted on the debt. Do you still have the letter, if not leave it as it is, it's 3 years off being removed from your credit history.

    It might do.

    I was thinking if you had the letter you have something from them saying the debt would be written off, although I not sure if the default would still stand as you defaulted.

    Does the letter mention about a default being given to you ?


    I'd see if anyone more knowledgeable would provide an answer.

    You could try writing to them saying as you received said letter you thought the debt had been written off. Include a copy of the letter with it too.

  • I'm no expert in this field but I would recommend posting on the Consumer Action Group Forum. There are experts on there who will be able to give better advise. Common sense would dictate to me though if they haven't sent you a default notice then the account hasn't actually defaulted? Is the account now showing as closed? If so, what date was it closed? Closed accounts stay on your file for 6 years after the date of closure (or so I'm led to believe) so there's a chance it will stay on your credit report for longer than another 3 years?

  • It looks like it's Aug 2013.thats the last update from the card provider

    As i said before its half way (or not far off ) the 6 year time limit for debts.
