Where else could I have posted.
I asked for assistance from people who have experience of OSC, clearly neither of the last two entries have so why post.
This post, in my opinion, concerns/should concern everybody who uses an ISP who encounters a 'complaints procedure' which is 'not fit for purpose'.
The Ombudsman Service are administrators for ADR schemes other than telecom matters, they are, in my opinion, passing off and merely support the 'trader' to the detriment of the complainant.
I never asked for a 'typing lesson' if there is a problem reading post perhaps a larger screen could be the answer or a new prescription.
Restricting replies to the requests contained in 'posts' would make this website more beneficial to users instead people read post replies having absolutely no relevance to original subject matter..0 -

I only posted to help you.
If you go posting long messages without breaking up into paragraphs people will not read it.
So whether they can help or not, you lose them.
Insulting me will not help people read your posts. It is not a matter of glasses it is about flow.
Pick up any book, newpaper or read any website, you will see Paragraphs.
It makes no difference to me whether people do or don't read your posts, but you might be wondering why. Thanks, don't you just hate people with sigs !0 -

Not one of the hits mentions broadband though so maybe add that or other relevant stuff to the search terms. If you mean on MSE for some reason then either the forum search or probably better with google..

The only hit for the broadband section seems to be your own post suggesting you are digging in a barren plot here.
Be sure to remember the excellent advice on how to get people to actually read your questions plus maybe make them more concise. I for one still haven't got past the first few sentences of your post without dismissing it as irrelevant to me. I did read some of the follow-ons though.0 -
DavidP24,
After mutually responding to three posts we finally have something we can agree on.The views expressed here are my own. I am not a Solicitor nor am I affiliated with any of the parties I mention. If you disagree with any of my comments please say in whatever way feels most natural to you. No one self improves in a bubble!0 -
holdon,
You appear steadfast in your refusal to give anyone an insight into the problem, assuming it isn't your BT email difficulty of August last year. Before I offer any advice I would really like to know what the matter is and which companies are involved.
P.S. How did that email complaint pan out for you? You don't appear to have updated the post which is always a little frustrating! Did they finally come back to you and tell you that BT provided you with fixed line telephony and broadband and that relying on them for email services was jolly unwise and that you should use s specialist provider if you require elevated levels of support/performance, by any chance? The views expressed here are my own. I am not a Solicitor nor am I affiliated with any of the parties I mention. If you disagree with any of my comments please say in whatever way feels most natural to you. The complaint to BT is still on-going, my recent post is about the same subject.
What I seek is somebody who has dealt with firstly the OSC secondly the PHSO.
It is the complaint process/procedure I am concerned with not my contractual arrangements with BT.
The OSC have obligation under the ADR scheme and have, in my opinion, failed to follow their own published guide lines, neither have Ofcom, as competent Authority, been of any assistance in overseeing the actions/activity of the OSC which has, in my opinion, allowed them to 'pass off'.
My concern is that 'maladministration' is causing the complaint to become diluted by the passing of time and the pure refusal of the OSC, Ofcom and the PHSO to answer correspondence/emails either fully or in a timely manner.
Original post now edited.0 -
holdon,
Although I haven't dealt with the OSC and the PHSO, I have dealt with the CMA, ICO and FCA at various points. I think it is fair to say that the parties you are corresponding with are busy, lack detailed knowledge of the subject matter (due to the diverse range of topics the needs to deal with) and tend to a formulaic approach as a result.
With this in mind, what more can you do to win these people over? The views expressed here are my own. I am not a Solicitor nor am I affiliated with any of the parties I mention. If you disagree with any of my comments please say in whatever way feels most natural to you. No one self improves in a bubble!0 -
The ADR scheme is regulated and requires the 'Competent Authority' to ensure that the 'appointed administrator' has adequate skill and knowledge to administer the ADR scheme, this I am aware of.
I am trying to get the regulator to regulate which I consider to be a reasonable expectation.0 -
Holden,
Without dragging this out any longer than is necessary, you appear to be attempting to wield a stick you do not posses and a view that these people need to capitulate, which they do not.
As with most things in life, forcing people to do things, even if you think they should be doing them already generally ends in disappointment.
As I pointed out in post #18, I have dealt with bodies like this for quite some time. Meeting face to face, humanising the situation and asking them what you can do to help them arrive at the outcome you desire is the only financially efficient path to success.
If the tone of your commentary on this post (to people with no vested interest), acting on the simple human instinct of try to help, is anything to go by, I can't say I'm surprised that things are not going swimmingly. The views expressed here are my own. It is not me dragging this out, all I am doing is stating what the ADR administrators are obliged to do under the terms of their agreement with the competent authority and legislation. There is a duty to comply, this is not optional but mandatory as mentioned in #19.
Had your reply to my post been based on your experience of dealing with BT, the OSC or PHSO your statements would have more relevance, all I seek is somebody with 'experience' of the organisations and the obligations imposed upon the organisations in question.
You seem to be quite happy for regulators not to regulate or organisations not comply with the various obligations imposed either by statute or agreement, I am not.0
