    I understand all your concerns but what you must understand is the PPC is a known scammer and this particular scammer can be beaten.
    Coupon-mad knows what she is doing and I strongly suggest you follow everything she says.

    taking them to court using the EA2010 would net you more money than whatever you may lose over a parking charge

    its a minimum of about £500 and so if you started at around £1500 as a claim it would moree than pay any parking invoice and a holiday in the sun :)

    correct , but not only that , It would warn them of there actions in the future ,


    hang fire , communicate where necessary and then hit them where it hurts.


    not only would you get a holiday , but you could then watch them squirm in CC as they were proved to have scammed you

    As regards the EA 2012, Unity Law have a very useful site here http://www.unity-law.co.uk/media_area/documents.htm

    There are also example template letters which can be amended and I'd recommend you go on the offence and write to the Managing Agents to point out their contractors are a) harassing a BB holder and b) they are vicariously liable for that harassment and c) you request they get their contractor to desist within 7 days and confirm the same.

    There is no need to have these guys come after you for up to 6 years when a clear statement early on [to people who can cancel] can solve it

    Now the right Answer:
    Blue Badges do indeed slip from dashboards in private car parks and on street, or are easily accidentally knocked by the disabled person as they climb out unsteadily - I have seen this happen with my late Mum who was very frail and would have had no idea she'd knocked her Badge down from my dash because she was more intent on not falling over or hurting herself as she alighted a vehicle.

    She used a wheelchair and would then not have been at eye-level to have seen the Blue Badge was missing that she's placed on the dash in good faith one minute earlier. My old Mum would have had no idea but in her case she was not the driver so was not alone, she was my passenger, so I always noticed and replaced the Badge (later, I started keeping blu-tack in my Glovebox for this very purpose).

    I rarely if ever agree with you and have little time for some of your previous contributions, but.....................
    ...having placed my father-in-law's Blue Badge folder on my dashboard a few times when taking him out in the car, I have to say that it would be some mighty wind that blows something that weight off the dashboard.

    Forgetting to put it on display or knocking it off when exiting, I can accept and should have no impact on the appeal, but always to blame a 3rd party for a ticket or BB not being on display - in most cases the wind - rather than accept some personal responsibility doesn't always sit right.

    I always tend to check my ticket is in view after I have locked the doors, and I would refuse to believe that, after locking a door and checking that my BB folder was on the dashboard, that the wind could displace it.

    I agree it probably was not the wind but a person in a wheelchair is not in a position to re-check the dash. Not saying the OP was/wasn't in a wheelchair, BTW, just saying that Badges do (more often than people realise) fall down and not all drivers can be reasonably expected to see that fact, if they know they did place it on the dash at first.

  • Ok, so it has been many months, and for fear of tempting fate, I have not posted before now. Basically, I stood my ground and did not give into the pressure tactics of the PCN issuing company. If you are put in the same situation, follow the amazing advice I have been given from the MSE members related to my initial post.
    Thank you all again for your support. I wavered and considered coughing up the monies for a quiet and easy resolution to the PCN, but I held faith that you guys were right, that is how those unscrupulous companies survive and they don't deserve to. Fantastic advice from you all. Many Thanks again! :D

    please bear in mind that these m*r*ns at UKCPS (or any other PPC) have 6 years to try a court case , so come back in the summer of 2022 with a bottle of bubbly :)
