Southend Airport Retail Park, on behalf of an elderly lady
1 - I have checked with the localthat day and is nning office and they have no applications for signage at the park. I have made a formal complaint to them this morning and they will investigate further. I spoke to PE and they sau its the landowners responsibility. They really dont get it do they!
2 - The date of alleged offense is 24th March by ANPR and the NTK arrived on the 12th April, well outside the 14 day limit. On the phone PE claimed to have sent it on the 2nd April so deem it to have been delivered 2 days later, but no proof of posting so basically they are saying its the recipients fault.
3 - I seriously can't believe there are 3 majors to this charge but the lady visited twice that day and so is being double dipped.
I don't know when planning will get back to me but I'll post it as soon as it's available. Can they really be that desperate. On the good side, the person at PE talking to me was very nice and polite but restricted by managers who can't see the bigger picture.

The 2nd of April was a Saturday; nice to see their office staff working at weekends!
I'm assuming that the "date sent" is not shown on the NTK, despite it being a POFA requirement.0 -
PE use iMail so it wan't actually posted on 2nd.
It was drawn up on PE's system, probably on Friday 1st and then batched into a group then submitted to iMail the following week. Some of these can end up actually put in the post several days or a week after the date on them which misleadingly says 'Date Issued' but is ALWAYS wrong.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Actually I just checked again and it does have a date sent . 1st April. I assume it still breaks POFA as that took an additional 11 days to arrive, not my fault.0

Yes but you can't prove that and POPLA won't consider it. The NTK will look compliant to them.
Does Southend Airport have bylaws which extend to include the Retail Park?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you for the links. I called Morgan Williams and they confirmed that it's not on but adjacent to the Airport, so it is relevant land.
It seems as tho PE think they can abuse the post service and POFA conditions by possibly backdating NTK's. They do seem to suffer with bad post quite a bit up there where as I've never had a problem with my post service. They should track their letters for something that has a cut off point in time.0 -

I hope you didn't out yourself as the driver when you phoned them? If you did, then it is irrelevant when the NtK is dated, or arrived, as you will have thrown away keeper liability under POFA as an appeal point.

They don't backdate their letters.
I've told you (above) what they do and the reason for the delay in every case. And they do not have a 'date sent' on their PCN either, I also mentioned what that date is. Not that POPLA would see it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
