Read the land registry practice guide on fences, it is very clear on the law on fences.

loveka, are you able to please provide a link to this site?

I have just been in your situation and have ended up losing a whole garden border, including 16 year old roses. Hopefully your neighbour is not a psychopath as mine is and will listen to sense. Good luck.

This was my fear as we too have some old rose bushes that I have been nursing back to health since we moved in! Fortunately the chaps taking the fence out have taken notice of me when asking them to mind the plants as much as is possible!

A good fencer can do the job disturbing very little ground with the right tools.

Maybe the neighbour is on good terms and will end up benefiting from this arrangement. We can only comment on what is written.

However, I'm firmly in the negative/can see a scam coming/neighbour getting ripped off/ camp. But I speak from experience. I wouldn't trust this neighbour with a barge pole and I'd even cancel my holiday to oversee all ground works adhered to both my specifications as well as legal permissions ;)

PS and for anyone accusing me of being overdramatic... future legal/court costs would far outweigh the cost of a holiday in the event the poor OP had to claim damages to land/fence etc via court! Not to mention the loss of house value due to neighbour dispute.

I'd tread extremely carefully in her shoes. Lots of alarm bells ringing her posts. Neighbour has left over Tarmac he needs to lay next week? Hardly legal or legitimate. Probably off the back of a council lorry tipping for a mate as they've screwed over the local council Highways dept. And this type of Tarmac isn't compliant with council/planning rules for domestic use.

When the OPs garden/house floods because of this newly laid drive her insurance will be void and refuse to pay out because it's non-compliant or even illegal.
