Car Accident Injury Claim

Hello all,

I need some advice regarding personal injury claim. I had an accident recently where someone undertook me, and cut in front; I swerved out of the way to avoid collision and spun out of control hitting the central reservation barriers.

The car was written off, and I injured my back hence ambulance attended. The third party drove off, and I'm not sure if my insurance has tracked them down.

I don't have personal injury cover on my insurance so could you point me in the direction of a website of solicitors I could approach regarding personal injury claim. Or is it not possible to claim for personal injury in such a situation?

    Either you track them down and make a claim against them, which any no win no fee Solicitors that deal with accident claims will handle for you or if you have the reg no. and it is uninsured, you contact the MIB.

    The personal injury part of your own comprehensive cover is not for these situations. You need to read you own policy wording. For your injury, you have to claim against a liable third party driver.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.
  • If the offending driver is untraced, then you need to claim via the MIB Untraced Driver Agreement.

    Either you can download the form from the MIB website and submit the claim yourself, or use a no win no fee solicitor to do it, they will want to keep 25% of your winnings.

    If you have legal cover on your car insurance, that may provide you with a lawyer, but quite a lot of the policies do not (or did not) provide cover if it was an untraced claim, meaning the lawyers would want 25% of the action.

    No witnesses. I only know the make and colour of the other car.

    Why are you expecting your Insurers to trace the third party, when you only know make and colour of the car ?

    I don't think your Insurers will be doing much. If you have comprehensive cover, they will deal with your car damage, but nothing else.

    If you involved the Police after the accident, they may have looked at any cameras they could access to see if they could identify the car. If the Police were involved, have you spoken to them ? If not, you should check with them, whether it is possible to trace the other car.

    The MIB might be worth calling, as i think you need to understand the situation and what options are available. Sometimes a two way conversation is easiest.

    To claim from the MIB, you need to satisfy their investigator that another car was involved and it wholly or partly contributed to your injuries.

    Have a look at the claim procedure on their website.

    Why were you gong slow in the outside lane?


    Why did you need to swerve? Did the driver that cut in front brake suddenly? or could you have simply braked to give space


    Something doesn't add up about this story

    Not necessarily, the "undertaker" could have been too impatient to wait for the lane to become clear when lanes 1 & 2 hadn't been clear enough for the OP to pull in earlier.

    Like, for example, the one in this article, although in this case the "undertaker" also clipped the other car and was caught with help from dashcam footage.
