Anyone had a PIP appeal?

Having had a reconsideration done my hubby is now trying to decide if its the worth the stress of going to appeal.

Im inclined to leave things as they are as I think the stress of fighting on may be more damaging to him healthwise.

Can anyone tell us what actually happens at an appeal? Do they go over both components or just the one you want to appeal and if so does that mean that you could be risking an award you have already got?

This gives a general idea of what to expect and how it goes. I have been to a couple and they weren't intimidating at all. In fact the members were kind and thoughtful to the appellants who I was accompanying. In both cases they concentrated on the component that was being appealed

As I understand it the tribunal can consider both components if evidence arises that impacts on the both. I'd strongly suggest that you visit CAB to talk through the whys and wherefores of going through an appeal

It will be for both components, so you risk losing what you already have. Good luck :)

My friend went to tribunal for her son's DLA to be reinstated. She was stressed about it, but on the actual day, everything was fine. She said that the tribunal judges had obviously read all the evidence. They asked her some questions about how her son's conditions affect him and what additional help he needs, then asked her to wait outside. About twenty minutes later, she was called back in and was informed that his DLA had been reinstated at high rate for both components.

Although she worried a lot about it, the tribunal itself was nowhere near as bad as she thought. Instead, she felt that someone was actually listening to her.

It may be worth it to appeal. According to Disability Rights UK, 61% of PiP claims that are rejected are overturned on appeal.

Not arguing with you but have you got a link for this. The only thing I could find was that both components are considered if the evidence presented impacts on both. In the two instances I have attended appeals they concentrated solely on the component that was being appealed and the judgements reflected this

As I say - not in any way disagreeing with you - just interested in the background

    Cheers
