HMRC have set debt collection agency onto me.

  • I had a letter today from them saying basically the same as the original poster. It dates back to 2007 when there was an overpayment from a joint claim me and the ex had. I agreed to pay off £5 a month to clear my half by this year. Done that, and now received letter saying that nearly a thousand pound is owed!!! I have read their code of practice 26 which states that a payment arrangement should be established when couples split up so that you are only liable for half of any overpayment but not sure if that was in place back in 2007 or if it's a fairly new thing or whether it will still apply to older debts! It's taken 9 years to pay off my half but there is no way I am paying anymore!! Not when the ex (father of my daughter) pays only £5 a week out his dole money). I have to work hard to compensate for his lack of support so I be damn ed if he is going to deprive her of another £500!!! I rang the collection agency and told them this aswell, he made some notes to say I have paid half etc and I will be contacting hmrc tomorrow to see what they say!! So stressed our with it. :eek:

    No its not, The HMRC has to inform all claimants Before ANY contact from the DCA to the debtor is made as it WOULD be seen as an unfair move to attempt collect the debt.


    As the DCA in this case has no legal standing to collect any debt from the OP, the OP is not obligated to communicate with that DCA.


    The DCA is merely a third party interloper with no legal power because they are wrongfully contacting the OP without first checking that due process has been followed by the contractor who hired them, in this case when informed about a no contact to inform of a DCA company involvement they are to immediately refer back to the contractor to deal with.


    DCA in this case doesn't matter in the slightest bit.
