Quick question does MOT & Insurance admin fee not considered as loss? I have free legal assistance with my insurance team. Do you think its advisable claiming this as loss from 3rd party insurer for no fault accident?0

The cost of your MOT is not a loss - it's a normal part of the cost of running a car. If you go out and buy a replacement car you'd expect it to come with an MOT - possibly 12 months worth (every used car I've ever bought has come with 12 months MOT) - so that's already included in the valuation.
Similarly servicing costs aren't a loss - any replacement car you buy will also have been serviced at some point (I would certainly hope).
I'd have thought that the admin fee for transferring your policy was more arguable (assuming it is an admin fee, and not an extra premium because your new car is newer/faster/more expensive than the old one) - but you might have to be quite assertive to get them to pay it. Ultimately there's an element of negotiation to these things and the question is as much "how big a nuisance do I have to make of myself before they give me an extra £50 to go away" as "what would I be legally entitled to if I actually took them to court".0 -
I know and can't be bothered of 50£ to fight as much waste of time & energy. However its just shocking as how subjective these industries are with lots and lots of confusing jargons and inspite of all these can't serve straightforward justice to what happened as "no-fault" in first place. Such a convoluted state of time we all live in. My law firm said that admin fee is not considered as loss and cant be recouped. I lost all my energy by now. Just gonna accept the market value of the car and move on. Have no choice literally tbh.0

I really can't believe how your complaining about getting more for the car than you paid for it!. (Text removed by MSE Forum Team) you can claim MOT and servicing costs because a car has to be serviced and MOT'd for it to worth the market value.
Just think about it would you pay as much for a car that has no MOT and service history as one that does?0 -
@takman, mate, its hard to comprehend the emotion involved.. its like spending 10 grand on a marriage and divorcing in few weeks just because someone else spoiled the relationship. Yeah yeah yeah legally its not correct to think/comprehend for a compensation for that. However every penny spent is a penny spent whatever jargon you put.
