Will question

Hi think this is probably the best board to ask. My partner and I gifted my brother the deposit for his recent house purchase. For this we signed a standard letter saying it was a gift and we had no interest in the property. Does this apply to after death too? He needs to do a will now he is a homeowner and currently has no partner or children so can he leave the house to us? Or is that counted as us having an interest in the property? If he can't leave it to us I presume he could leave it to my children?

    He can make the will without any problem. Tell him to use a solicitor not a will writer. That way he will get proper advice on allowing for different circumstances.

    As long as the gift did not come with the condition the house must be left to you or family then no problem.

    He can leave it to whoever he wants including you and the fact you gave him some money earlier is irrelevant. ( as long as said it didn't come with conditions, and you did say it was a gift)

    As he doesn't have any partner or children, he could leave it to various charities. So, depending how old they are - advise your children to be 'nice' to him.


    If my Partner goes before me, that's what's happening to my Estate!!
