    Ignore everything except an LBC or an MCOL, for 6 years.

    It wasn't an appeal, just a statement of fact and a list of questions as per the template. It was sent after the NTK and after the period stated on the window ticket. he letter was sent as the keeper. The questions went unanswered. The text would seem to be their standard stuff.

    I know, but the list of questions IS a valid 'challenge' and should have elicited an 'offer' of IAS. Never mind, you wouldn't have taken them up on that offer anyway so would have been in the same place now, regardless.

    Ignore - except if you get court papers or a LBC from the parking firm or solicitor (NOT a demand looking like a 'court threat' from a debt collector wittering on about 'the Beavis landmark case' and Court - that's all drivel to ignore).

    Hi All,

    Thanks for the help on this forum so far.

    Brief overview so far -

    1.ES parking enforcement ltd - fluttering ticket.
    2. Their claim rejected, usual appeal to IAS option withdrawn by said parking company.
    3. Chased by Wright Hassal - ignored.
    4. LBC from Gladstones.
    5. Sent initial response - (thanks Loadsof children for good letter basis)
    6. Now in receipt of second Gladstone letter, with usual trash quoting Elliot v Loake, and threatening to issue a claim in 14 days.

    Now, 2 things -

    a) They keep writing to a previous address, despite ES and Gladstone always being told, explicitly, the contact address (consequence is second letter has been received after their 14 day deadline). Im concerned if this continues (sending to wrong address) that I will miss the court papers and end with a judgement in my absence.

    b) How do I get the court, assuming we get there, to consider my costs/compensation for distress and costs asociated with defending the (entirley baseless) claim?

    I will post my draft defence, if I receive court papers, for your critique.

    I am not a great fan of ES.
    I am currently battling them for a similar 'fluttering ticket' case.
    Maybe my thread will help you.

    Have you written to them explicitly telling them your correspondence address has changed?

    Prove, not easy to do, that they have behaved unreasonably. If you can you can claim extra costs under CPR Rule 27.14(2)(g) when you win at court.
