Hi,
This company operating in Warrington placed a PCN on the car, despite having a valid ticket. I did some research on here, and another similar site and on the BMPA.
Waited until their letter arrived in the post, then I sent a reply to reject the charge (thanks for the template in the "Newbies" thread). The letter was rejected and they now say they wont engage with IAS as their procedures haven't been followed.
Options given by ES in their reply are (i) Pay up OR (ii) They may seek to recover the charge through debt recovery or may proceed with court action.
I have already said in my letter that I wont respond to debt collection letters.
If anyone can offer some guidance now it would be appreciated.
Thanks.

Can you expand this? What do the photos show? Have they been doctored?0 -
I have recently got a charge from this company, when researching they are coming up like a cowboy company. You get a file not found, when you click the how to appeal on their website?!
I parked in manchester on a street where there were no yellow lines and no signs. the only signs we could see were on the other side of the road, not where we parked and one was even sideways so not visible, we only saw them when we went back to take pictures of where we parked. they are not readable from where we parked or evident they are connected to hat peice of land (which fitted about 4 cars)
the photo was taken by hand, you can tell and you can visible see no yellow lines (luckily my fella parked a bit away from the curb) and no ticket was left on the car, it was sent to the house.
The parking charge was dated 28th March, the letter was dated April 1st (if only it was a joke!!) and the envelope was dated April 4th - which means we received it April 5th/6th. It said we had 14 days from the letter date, which means we lost 4/5 days in transit of this letter.
I know i have a right to appeal, but worried i might get it wrong or like the poster above, they reject it.
Im new to the forum and have spent about 4/5 hours of this evening reading so much, my head is a little fried!!! Can anyone guide me to a possible template, or advice what i need to write? I found a great template but all linked to the BPA rules and regs.
thanks in advance guys - any help or advice would be very much appreciated! I get married next month, losing £100 to these guys will be gutting!!!0 -
vicster, your first task is to start a NEW THREAD using the red NEW THREAD BUTTON, top left of the forum
then each person gets their own specific and bespoke advice
thread hijacking is just not acceptable on forums, hence my request to you to start your own thread, which is out of respect to the OP of this thread, and to everyone who starts their own thread
ps:- the info you require is in the NEWBIES FAQ sticky thread, about 3 down from the top of this forum, IPC and IAS sections0 -

There are no photos - returned to car and there was a sticky on the windscreen, and like some other unfortunate people have reported on this site with this company, the payment ticket had blown over so it was face down.
Thanks to all for posts so far.0 -
The letter was rejected and they now say they wont engage with IAS as their procedures haven't been followed.
Why do they say this, what do they say?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Their letter says "Unfortunately we are unable to consider your appeal. As stated on the Parking charge notice all appeals, from the Driver, must be received within the stipulated time of issue. After receiving the Notice to Keeper the registered keeper may appeal if they have not already as the Driver. As your appeal was presented significantly late the appeals procedure as now closed and the Parking charge will stand."
I used the template letter from the forum asking them to confirm the landowner and their agreement with them etc. None of the information requested was provided. I'm making separate enquiries to find out the landowner.
Thanks again for the posts.0 -
After receiving the Notice to Keeper the registered keeper may appeal if they have not already as the Driver.
So was your appeal sent 'too late' after the NTK? And did you only call yourself the 'keeper' in the appeal? Not that we are saying to do anything else expect ignore the debt collector demands, just wondering - why would they think the 'driver' appealed late, if you never said who was driving?

They had no reason to withhold the 'ADR' of IAS at all then, as you challenged the PCN as keeper, in good time after the NTK. Pathetic but it surely works more against them than you because IAS wasn't worth trying anyway and if it ever proceeds further (highly unlikely) then withholding ADR just looks unreasonable.
I know you've seen the BMPA advice but just for any newbies reading this:

''SHOULD YOU APPEAL AT ALL?
Our recommendation for this operator: Ignore but keep paperwork.''PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
