Parking eye Help

hi everyone I need help! I was sent a penalty notice by Parking Eye last year I appealed to POPLA and my case was on hold because of the PARKING EYE V BEVIS case. This morning I have have received a solictors letter from WRIGHT HASSALL (lol) Solicitors asking me for evidence within 7 days. I am unsure what to do now, any ideas guys?

This looks like the first of the assessments being conducted by WH on the on-hold cases when London Councils relinquished their role with POPLA.

Can you scan a redacted copy of what you've just received from WH to make sure I've made the correct assumption here?

Use Photobucket or TinyPic to host then post up the URL here, but change http to hxxp and we'll do the conversion - newbies can't post live links until they've got a few forum posts under their belt.

then post the link with a broken url

Not sure how to do that. Basically the letter says they are acting as in independent appeals body.

We know that. Loads of threads about it if you search the forum.

Show us a pic of the letter, please, as we haven't seen one yet. This is new this week.

Host a photo on tinypic or in Dropbox then show us the URL link, changing 'http' to hxxp.

if you take a picture / scan the latter remove any personal identification like name , appeal number ... in a program like paint ..

then pick/google either 'tiny pick' or 'photobucket'

follow the website instructions to host the pic ...

it will give you a url (address) of the hosted pic ......

you post that link here after changing the http bit ........

We have been appointed by the BPA to act as an independent appeals body, under the brand of Parking on Private Lane Appeals (POPLA) in respect of the appeal and to consider both the Appellants and the Car Park Operator's positions before providing a decision to the parties. We are not instructed to act on behalf of either party.
POPLA received a number of appeals that related to the PCN not being genuine Pre-estimate of Loss (GPEOL) Your appeal had been initially marked at GPEOL appeal and was therefore placed on hold. You should of received a letter confirming this from BPA at the time.
The reason your appeal was placed on hold was due to the case of ParkingEye V Beavis, which was being heard in the Supreme Court. This case addressed the requirements of GPEOL. Judgement was handed down on 4 November 2015 and confirmed PCN is a necessity to ensure proper use of a car park, and also to ensure that there is a commercial justification for the car park operator to manage the car park

it goes on .........to say that given the length of time that has passed since the appeal was lodged, we have been asked to contact you to provide further evidence in relation to the appeal...you must send evidence within 7 days

Did the letter actually say 'should of'?

I think we need to see your original POPLA appeal as I'm sure you will have appealed on many more grounds than just GPEOL, and we need to consider a strategy for pushing hard on these other grounds as GPEOL will likely be too much of a heavy lift on its own.

This is the first (to my knowledge) of the WH POPLA processes to hit the forum, so there won't be instant, show-stopping answers from us at this early stage - we'll need to work with you (and you with us) to develop something to throw back at WH.

What kind of car park was this? Free retail park? Pay and Display? Hospital car park?
