Parking Eye - Boscombe Aldi - After Store Hours

Hi All,
I've just returned from holiday over Easter to find a 'Parking Charge Notice' from Parking Eye for £70 relating to a 22 min stay in the Aldi Boscombe carpark after they were closed on Sun 13th Mar.
The Notice is supported by ANPR still footage of the vehicle registered to me entering and leaving.
I cannot tell when the notice arrived as I was out of the country from 25th Mar until 10th April and the envelope has no postmark on it. I probably cannot claim that they sent the notice outside the 14-day window described in para 9 of POFA.
I have until 15th April to pay in full (having already missed the 'early payment discount' window of 1st April).
Grateful for advice on whether an appeal is merited using the process I have found elsewhere on the forum. I plan to revisit the site to check exact signage etc later today.
Many Thanks...

Appeal exactly as the newbies thread on here. You can add that the alleged invoice has no commercial justification as according to their ANPR figures, the alleged incident happened when the store was closed. Therefore there was no need to ensure parking space turnover. Furthermore, if the intention is to prevent people using the car park at all when the store is closed, a gate would suffice.
Then they'll reject it and you beat it at POPLA0 -
online appeal as KEEPER using the blue text BPA member appeal0

Thanks Both. Used the BPS member appeal text appealing as Keeper. Will update thread with outcome...0

Boscombe Aldi requires you to enter your reg no inside the store, or get a parking charge. I see a few cars parked in there at times after closing time, must make PE a fair bit of cash.0

And obviously complain to Aldi Head Office as well, online 'contact us'. You can get a reprint of the receipt in store first, as proof to add to the complaint to Aldi and to email to:
info@parkingeye.co.uk
...mentioning that you have already appealed and here is the driver's receipt (NOT 'MY' RECEIPT!).
As you were on holiday, if there is no family member in the area to get a receipt re-print for you, can you supply a bank statement as proof, unless you paid cash?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

CM - I think the OP parked outside of opening hours, so no receipt available?0
-
@OP - as catfunt says, parking outside of opening hours means you probably don't have a receipt from that day.
But are you a regular Aldi shopper with receipts from previous shopping trips (wherever - not necessarily from the 'infringement' site), in which case you can contact the Aldi HQ, send them copies of receipts (or redacted bank/credit card statements) and ask them to intervene. They will help regular shoppers. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi All,
I received an 'unsuccessful appeal' letter from ParkingEye with the POPLA number. I have not yet heard back from Aldi so I don't know whether to chase their view before appealing through POPLA?
The driver is not a regular customer of Aldi and the stay was 20 mins after store closed on a Sunday. No receipts from there or another store to show customer services.
Thoughts welcome!0 -

You shouldn't wait for Aldi, but need to get on with researching and then drafting your POPLA appeal. You have 28 days available to appeal to POPLA - check here to confirm your deadline date.

As always it is critically important to know what is written on the signs? Is it clear that there is no parking out of hours? or is there just reference to enetring the registration number on a keypad in the store? If the latter then the argument would be frustration of contract while if the former there is no offer of parking therefore no contract.0
