    Is the seller contacting their solicitor daily as you are yours? If not, what to they propose to do about the situation?

    The seller needs to sort their solicitor out. O.k so there are almost certainly probate issues but somebody needs to tell you what's going on.
    If the estate of the husband wasn't administered correctly ( or at all) somebody's got to unpick the whole mess, Work out how the property is dealt with, who owns what ( it may have been put in a trust, or it may have been left so other beneficiaries inherit the house) but the wife could live there until she died. There may have been a will for the husband or no will.
    Until the husband's estate has been properly sorted out, the wife's executors don't know if it's hers to deal with.
    Basically it *could* be mess. It could be fairly easy to sort out or it could be the sort of thing that drags out for over a year, unfortunately there's no way of knowing.
    Unfortunately probates generally seem to take ages, there's lots of paperwork and dealing with officialdom seems to take an age, even for simple queries.
    I'd love to think that you'd get this all wrapped up within 5 weeks, however realistically it's not looking good :(

    This sounds similar to my situation a year ago. My father died several years before my mother but for some reason we didn't apply for probate for his estate prior to her death,

    Our solicitor did both at the same time although it was a kerfuffle and took about 7 months. I should add we didn't put their house up for sale until that was sorted.

    Hi All

    The seller has been in contact with his solicitor...apparently assured that the situation will be sorted before the mortgage deadline!

    I know the situation hasn't been helped by the fact that when her late husband died, they didn't apply for a name change.

    I am assured this paperwork will be completed in two weeks, and that is that. My next steps now are unclear, do we wait now until the two weeks has passed? And then once that is sorted how long will it take before we can sign?

    I am sorry, I knew buying a house could become complicated...but this is something else entirely :(
