I need help re ESA
I have moved to sheltered housing (60) my age due to a decline in my health I receive DLA and a small occupational pension.
I own my flat which I have let as I intend to go back in the next 6-9 months . The rental income I receive from my property pays for the following
My rent for shelter accommodton
My council tax
My mortgage on the property I own
I applied for ESA income based this has been disallowed because I have to much money coming in from the rent but this goes straight out to cover my living costs at my new address .
I was asked to complete the form a64a (interest in a property)which I did and also had to send all kinds of evidence .
It was all sent to a dessison maker and I have been told verbally this has been rejected but that I have the right to appeal
Can anyone give me any advice or point me in the direction to an organisation the has some knowledge of these cases .
They count the value of my property as capital which is of course over £16000.00 the limit
Please help any comment welcome

This is a difficult one because you don't say why you moved into sheltered accommodation rather than staying in your own home and receiving help and why you intend to return in 6- 9 months.
It may be possible to have the DWP apply a disregard to your property - capital and income in certain circumstances - but difficult to say without further details.
As regards advice then you could try CAB to help you with the appeal.
Again. without knowing all the financial details it is difficult to know whether this may be a budgeting issue since your occupational pension would be deducted £1 for £1 from any income based ESA and this could mean that you may not be entitled to ESA solely on those grounds.
Even if you are not eligible for ESA because of your pension you may be eligible for HB and CT reduction based on a low income. However, the capital and income from your own property may still prevent you from receiving these benefits unless any disregards apply.
Best advice is to contact CAB and see if they can help or perhaps AgeUK.0 -

I moved from my property due to a decline in my health the sheltered housing this is only a short walk from my sisters home who looks after me ( she is not my career )while I am going through this rough patch . I am planning to go back to my home at the end of this year.
My pension is only £233.00 per month and DLA £220.33 this is the only money I have .
I have also been place in the ESA support group even though I don't receive any payment

I was living on ESA work related activity group but due to being unwell I just gave it up stupid I know but I just couldn't cope with the pressure they kept putting on me and that's when I started to go down hill
I have since been placed in the ESA support group (having had 2 health assessments this year)
I hope that is some help
