    How long ago was the CCJ granted ?


    Why did you not receive the court papers ?
    Does the creditor have your correct address ?


    Are you 100% positive a CCJ has been granted ?


    How many accounts do you have, and how many have had CCJ`s granted ?


    Sorry for the questions, but it seems you have a number of issues here that for some reason or another, have been allowed to develop, when this should not of been the case.

    Another point, you should make a PPI claim from the original creditor that sold you the policy, as it was obviously mis-sold to you.

    Look on this site for "how to reclaim PPI", get a complaint banged in, and get some money back.

    Hi sourcrates,

    They have my correct address as I've not moved.

    I have a lot of accounts and quite frankly I was just not well enough (mentally or physically) to deal with the battle when things started going wrong. None of my insurances covered me so the money I had forked out on having insurances over the years was worthless in the end when I really needed help.

    I had very large credit limits on a number of things and they wasn't even maxed out, for example I had a £7500 limit on one of the catalogues, yet owed it £300 and had been a long standing customer of about 5 years, never been in trouble with payments before and when I lost work and became unwell, nothing covered me!

    So I have four ccjs on my credit profile.
    3 are from 2014
    1 is from March 2016

    I have a number of defaulted accounts totalling an apparent £19000 debt, majority are with lowell

    Now I think I can clear this in about 18-24months as I am now back working on a good wage. But my problem with it all, is ......

    1. I don't really know what I'm doing
    2. I'm unsure whether the balance is true and suspect the majority is charges added by the debt collection people.
    3. I think it's unfair as I did have payment protection insurances for if I ever couldn't manage payments

    I fully accept I got into debt and messed up, meaning it's my responsibility to correct it. But I also feel a bit shafted and even if I clear them they will stay on my file as defaults which is crappie, but again I know that's just how it is.

    And to add, I think I know what a CCA is now, its like proof of your debts?

    I read something on another site and it states not to pay a £1 fee for it as it will be deemed as admitting the debt and could start the 6 years again, that will not be good as I'm sure one of mine is due for removal this month

    You have 4 county court judgements, but say you never received court papers for any of them ?


    I find that impossible to believe, they must of sent the paperwork for each one, giving you the chance to either admit, or defend the case.

    Is it possible due to your other problems, the paperwork was overlooked ?

    Putting that aside for the moment, with regard to the PPI, you should get a written complaint sent in immediately to the original lender, you should be able to reclaim all your premiums, plus simple interest at 8%.

    If an account already has a CCJ registered, then doing a CCA request is irrelevant, but you are incorrect, in that the fee must be used for the information request, and cannot be used as payment against the debt, and again, if a CCJ is registered, the account will not be statute barred either.


    Lowell do not add charges or interest, they are barred from doing so, unless the original agreement says they can, 99% don't.

    This is quite a mess you are in here, but I would defiantly pursue the PPI reclaim, you should get something back from this.

    Hi no I meant the recent one I received no court papers for, the earlier ccjs I did but I still had my head buried in the sand back then and was unable to even look at letters. But the one put through this year I didn't, and I was in the process of dealing with it when they passed it to fredrickson.

    Yes it's quite a mess but I am now in a much better position and will get myself out of it. I think I just need to keep reading lots on here as I don't know enough of how to deal with it.

    Is a CCA worth doing for the other defaults?

    I have begun requesting information from my catalogue accounts via resolver as I don't have all the paperwork because I had the accountS for so many years I only kept the last 2 years statements. So I have requested information because I do not know how long I was paying the insurance on each one. Some I know I took out straight away but a few I think I added at a later date.

    Ah, ok, that makes things a little clearer.


    You could petition the court for a set-aside motion for the latest one, but as the fee has just gone up to £255.00 with only a marginal chance of success, I doubt it would be worth it, just to get back to square one again.


    Any relevant account, that's not had a CCJ registered, then yes, a CCA request is specifically worded so as not to admit any liability.


    Please make sure you get a complaint in about the PPI, and don't be fobbed off if they say no, you take it all the way to the financial ombudsman if necessary.

    Thank you so much, yes I am definitely going to pursue the ppi claims as I had it on so many accounts and whatever I get back can go directly to my debt's and help clear them off.

    It is a total mess but I am going to work bloody hard to fix it! One thing that keeps me going is the fact that I do not want my kids to copy my mistakes, I didn't have a loving family and I often used available funds on credit cards etc to pay for things like deposits on accommodation for me and the kids when I was single. I had no help from family in times of need and I don't receive maintenance to help with kids, never have done. So I just got us by whichever way I could because my wages wasnt great, and obviously that wasn't the best way. I so envy people who have families who help out with things like childcare etc. Luckily mine are nearly at secondary school now so my childcare fees are almost over with! Hooray!
    So if there one thing that will keep me going it's to get debt free so I can begin a savings account for each of the kids so that they never have to be in that position when they are older! I will get there with lots of hard work :)
