Lowell Help

Hi all, I have received the following when querying my credit report and I don't understand because of the dates, so are they not removed after years? As some are 2009.

I'm writing in relation to your recent query with:

*Lowell Portfolio I Ltd Accounts started 24/02/2009, 23/04/2010, 30/07/2010, 17/08/2010, 20/07/2010, 26/02/2009, 08/11/2010, 26/03/2009, 09/01/2010 and 09/05/2012

They've confirmed that this information is accurate, so I'm afraid I can't make any changes to it.

They state that you need to provide proof of payment so Lowell can investigate further.

I understand that this may not be the outcome you were hoping for. If you'd like to discuss their decision, you should contact them directly. Their contact details are:

    What is the nature of the information recorded for those various dates - defaults, judgments, or just missed payment markers?

    Now this is really confusing, I will give an example to better explain.

    So on the one that says 26/02/09 on my credit file it states account started: 26/02/09 and the default date as 15/01/13. So that means I'd have around 3years left. But if they have had the account since 2009 then I defaulted way before 2013.

    I'm confused I don't understand how this works because I read that the default date was the date of last payment/missed payment but it can't be ?

    Start date is when the account was started reporting with the original lender, not when Lowell acquired it or the default date.

    Thank you, so the default dates listed on the credit report are the dates I need to go by?

    So that means they are statue barred from the default date and not the last payment ?

    Default date on your credit report has nothing to do with any statute barred date, ever.

    Time starts ticking on the statute barred 6 year clock for the first time when:

    - when the creditor is able to take legal action for breach of your agreement or non payment. The exact date may depend on the agreement in place.

    then once that has happened....

    - the 6 year clock can be reset each time after that when you make a payment or acknowledgement in writing.

    Nothing on your credit report can reliably tell you when the debt becomes statute barred.

    Thank you Fermi, my credit report is a mess to be honest. But I'm slowly going to pay them all up, is it worth trying to negotiate with Lowell for them to remove the defaults if I make full payment? Would they consider that at all?

    The entries will drop off your file, 6 years from the default date regardless of if they have been paid or not.
    You could mention in any negotiations with Lowell about removal of the default been a condition of settlement, it has worked in the past with some people, they can do it if they wish, but its very rare.


    It only usually happens if an account is deemed to of been unaffordable to the debtor in the first place, and then usually only with payday loans.

    Thank you sourcrates I think I will give it a try and see what happens. I'd like to pay then up and avoid ccjs as I already have a few. When it emailed Lowell about repayments they haven't got back to me, previously when I was attempting to arrange repaymeets with them they went ahead and allowed a ccj even though I was emailing them about repaying, so they really annoyed me because I was awaiting their response then a ccj went on!

    You do realise there is a court process to go through in order for a creditor to obtain a CCJ don't you ?

    They cannot just muster them up willy nilly, did you receive court papers ?

    Another thing with Lowell, they are a firm of specialist debt purchasers that buy up large amounts of delinquent debt in batches, without any supporting paperwork whatsoever.
    I am assuming your accounts were loans and/or credit cards, if that's the case, it will do you no harm at all to CCA all relevant accounts before you do anything else.

    Hi the accounts were catalogues, credit cards. I had Insurances on the catalogues for if I became unemployed but they didn't cover me when I did because I was self employed. Then it all got into a mess Lowell took over them. I was in the process of emailing back and fourth trying to resolve them now I'm working again and then a ccj went on and I queried it but they said they had sold it to fredrickson, so was nothing they could do about it.

    I didn't get the court papers or I'd of informed them that I'm already in communication attempting to resolve it,

    Sorry I don't know what a CCA is?
