3.1 Without limiting the other rights and remedies of the Landlord, the Landlord may seek to lawfully terminate the tenancy by obtaining a court order if:
3.1.1 the Rent or any part of it is in arrears, whether formally demanded or not, or
3.1.2 the Tenant is in breach of any of the obligations under this agreement, or
3.1.3 any of the grounds of Schedule 2 of the Housing Act 1988 apply (these grounds allow the Landlord to seek possession of the Property in specified circumstances, including rent arrears, damage to the Property, nuisance and breach of a condition of the tenancy agreement), or
3.1.4 a notice is served under section 21 of the Housing Act 1988 (section 21 gives the Landlord a right to end an assured shorthold tenancy without any specific reason, though only after any fixed term has ended, or in operation of a break clause),
Tenants who are unsure of their rights should seek advice.
This was the bit I read that I thought was in the break clause, got the sections mixed up as this is the section after the break clause.0 -

That is NOT a break clause, since nothing within it permits either side to end the tenancy earlier than the end of the fixed term.
All it does is specify that following the end of the fixed term a Contractual Periodic Tenancy will arise, rather than a Statutory Periodic Tenancy.Possession

I was talking to my friend who's an estate agent (and an honest one who's very nice! ) and he mentioned about a change that was coming in and was just reading up about it as I walked in. He said it wouldn't have any effect on my daughter's situation, I was just curious as to what it was.
The open house/viewing is on this weekend so ill talk to my daughter and see if she has any more news. Thanks everyone.0 -
They are quite ok about the viewings as long as they have notice as they have a dog
Hopefully the requirement to provide notice is known and understood by all the staff at the agency. It's possible that someone forgets to send the memo round or add the note tot he file, and an agent just turns up because as far as they know viewings are acceptable.
If your daughter finds that a viewing happened without notice, perhaps that would be the right time to change the locks?
I recall sitting in my pyjamas in my old girlfriend's rented flat and the agents would bring people in without even knocking. They'd just let themselves in.
It's not a pleasant experience.0 -

We'll just have to see how things go this weekend. Everything is all lovely lovely and friendly but I need to talk to my daughter in more detail. Can't talk to her at the moment as she's awaiting a phone call about the job she went for yesterday. If she gets that it may change the situation.0
