I know someone, who lives in a block of flats, where there is a free open car park as well as a locked underground area whose bays have to be paid for.
These flats could be advertised as having above ground and below ground parking available, even though getting an underground space is very difficult, as a number of residents have more than one space and these are allocated on a first come first served basis, with any coming available quickly grabbed.0 -
They put "off street parking" - which I took to mean off street parking I can use. Unfortunately I'm not allowed to use it under any circumstances (not even the option to pay separately for it)0

It may well be that the seller of the flat didn't have a car, so never used the parking. Or they used the parking even though they may strictly not have had one allocated to them but had an arrangement with another flat owner who did. Is this something you can ask your neighbours or the managing agent?
If the flat didn't have off street parking, would you still buy it? Just trying to work out what your loss is as I assume that's what a court would be looking at.0 -
Your sol should have verified it in the lease and should be mention of it in the legal pack.0

I really think you have to chase your solicitor on this one. On the face of it you've been mislead - a flat without a parking space would be worth less than one with a space so the venders have gained from this.
It's reasonable to assume based on the answers to the questions that the flat benefits from a space in that car park. I would assume if parking provision was provided elsewhere then the management company would have said as much.
You need a response from your solicitor- if they are taking too long to respond then complain.0
