Halifax CC fraud

I am posting this on behalf of the hubby, he has got a CC with Halifax which since before December has been sitting over its limit due to a reoccurring payment which keeps going out. Now he didn't realise this (daft I know) until February as thought it was due to him overspending at Xmas. Now we have gone through his statements and this has now been going on for 5 months! The amount is $49 which equates to roughly £35 and then he is also being charged for the conversion from pounds to dollars at a silly conversion rate! Now we have searched for the website that he is apparently subscribed to and it doesn't exist. Having spoken with Halifax they initially agreed that it could be fraud and they would try and refund him all of the payments and subsequent charges etc. However they have now changed their mind and decided that he must have signed up for a subscription service willingly and it's his own fault. All they have done is cancelled the payment and sent him a new card. Where do we stand with arguing this is fraud? As in total it's in excess of £200 including all the subsequent bank charges and conversion costs etc.

    Check the statements on a monthly basis.

    What's the entry that's alongside the amount charged on the statement.
  • its eliprise.com 39.95usd @1.4350 then he is charged £12/ month default fee as this keeps taking him over limit

    It's not sufficient for them to state "he must have signed up for a subscription service". Whilst many of these cases might indeed be cardholder error, given your husband has disputed these transactions, it is now incumbent on Halifax to prove he authorised them.

    Make a written complaint (perhaps via their website). Depending on the outcome, you could escalate to the FOS.

    What currency is the card charged in? Is @1.435 the 'stupid' rate?

    That's actually quite a good rate at the moment.

    Formally complaining, stating that it's up to them to prove the transaction was authorised may be the best option.

    There's an odd website at http://eliprise.com/ which appears to sell work books for $35. It doesn't offer an online credit card ording system.

    The domain was registered on 8th April 2015 to a company that's located in the UK. It's hosted in the UK too, which seems odd for a small enterprise located in Canada.

    My apologies I am not 100% sure with exchange rates but I was led to believe this was high :o

    Not worth it. The branch staff can do nothing really. You already gave Halifax the chance via the "informal" route (by calling them). Now you need to put it in writing as a complaint (you have already told them the transactions were unauthorised and they have re-debited despite failing to provide evidence of authorisation). This if for two reasons: 1) they are more likely to take it seriously rather than fob you off. 2) it makes it easier for you to go to the FOB because you can show you have reached a deadlock with Halifax.
