Old debt capquest

Hi.
Had a letter from capquest swiftly followed by a second one. Says they bought debt from arrow. Never heard from them. Original creditor lloydstsb loan. Last paid I think Jan 2010 and spoken to try to arrange lesser payment in Feb 2010/ never dI'd make reduced payments.
Want to avoid ccj and court action due to nature of job, how do I start to deal with this CCAcapquest ? SAR lloydstsb /in which case who as they are split again? And also does any action acknowledge debt. Hoping SB. Thanks in advance !

Up to you in the end, if your dates are correct, it will be statute barred by now.

Thanks for your replies- as I am not 100percent sure of dates (only as I do not have paperwork or a written record,however,pretty sure) what's the safest course of action. Don't want to wade in with SB and I'm wrong - although I did think the reduced repayment offer may indicate not enforceable. Please would someone be kind enough to direct me to any letter template if indeed it is SB I start with(or whatever may be appropriate). Thank you so much0

It's up to the creditor to prove it isn't SB, not up to you to prove it is.

Ah so this letter itself does not constitute an acceptance or restarting of the 6 years from default (if not SB)? if I send this with tamper proof signature to Capquest then see what happens? Are they able to commence court action if it is SB - as in whilst it's in debate with me querying stuff with them?0

The sample letter soucrates linked to is worded so that it doesn’t acknowledge the debt. There’s no harm in sending it to see what they come back with.

May I check is SB from default date - date payment first 'not paid' or default date listed on credit file. Seems ambiguous - and if it is debatable would I be better to wait til nearer to the dd on credit file 28/07/10?0
