Back fence in disrepair, neighbour won't help!!!

Sorry to have a similar thread.... related dilemma.... but slightly different

We recently have purchased a property which was previously lived in by an old couple who have not maintained the garden at all.

We own the fence to our right and our neighbours to our left - both these are in good condition.

However the rear fence which is shared with the neighbour at the back needs to be done as half of it has disintegrated and fallen apart. This rear neighbour seems to have a junk pile to one side which has pushed the fence and is coming into our boundary.

The whole fence needs to be redone, currently we have used some doors to secure our garden (as we have a dog) but whose responsibility is this? There is no mention in the deeds.

I am happy to pay half (even though we are now totally skint after being first time buyers) but they are not happy to help out with costs, and will not clear up there junk pile!!!

We've just moved so I don't want to rock the boat with new neighbours but surely they must have some responsibility?

    They are responsible for ensuring that their pile of junk does not come over the boundary onto your proprty, they do not have to pay towards a fence. There are no laws that say that there must be a fence/hedge on a boundary, if you want one then ultimately you will probably need to pay for it.

    just replace it.. they clearly don't care, you do.. so sort it to your satisfaction. You can't force them to do it.

  • And if you have a dog you can get a fence that suitable for your needs rather than a make do fence that they may put up

    To summarise: No they have no obligation as there's no requirement to even have a fence on your boundary.

    Solution: as you have dogs you don't want escaping just pay for it
    yourself.
