Can i take legal action against Wonga?

About 3 years ago someone applied for a Wonga loan fraudulently using my bank details. At the time it was all sorted between Wonga and my bank and the police were informed. However a couple of weeks later I did notice that Wonga were still taking money from my bank account. I got back in touch with them and they said they would sort it out. My bank also changed my account number so they couldn't take any more money from me. For three years I haven't heard anything and haven't thought much about it, but I am currently in the process of applying for a mortgage which I have been rejected for. I accessed my credit file and I have 3 years of default payments to Wonga, so they never actually cancelled the payments coming out of my bank account. They have said its going to take at least 30 days to rectify but by the time this is sorted and I manage to get a mortgage offer I am worried that I will have missed out on a house that I want to buy. Is there anything else I can do? I have asked Experian to put a note on my file. Can I take legal action against Wonga?

I know it's easy with hindsight but you should have had a look at your credit files before thinking of getting a mortgage.

Contact the Office of the Information Commissioner. Wonga have certainly broken the law relating to Data Protection, and that is the body responsible for enforcing the law.

Its not really the issue though. the issue is that Wonga have given me a bad credit rating as when someone has frauded my bank account they haven't cancelled the repayments.
