Trying to get a default removed from my credit history

    They received a default just the same as I did. They refused to remove mine stating that they have duty to ensure that peoples credit files are a true reflection of there borrowing. But in this case, they have chosen to use their discretion. In using their discretion that persons credit file no longer accurately reflects their borrowing history as they have had a default, just as I have!

    So why is it fair to apply the rules to me and not them?

    You've asked them to remove it, they've refused.

    Either accept that and move on, or fight them through the courts.

    If anyone else has anything to suggest I would love to hear you ideas. Nobody ever achieved anything with pessimism and negativity! I like to think that anything can be achieved with the right knowledge. Someone on here could have information which could lead me to getting this removed without having to go to court. Who knows! I welcome anyone's input.

    Plenty people did with realism and an acceptance of when to move on from something, though.

    I worked at Orange for a long time and had dealings with the the Exec Office and the Credit Referrals Team. In my opinion, you're on a hiding to nothing. The response you have had is quite a generic one, but using your details to pad out the way they say 'no'.

    Without knowing the reasons for the other person's default being removed, it is hard to comment with accuracy, except to say, it is possible that there was some ambiguity with their default in the first place, which can happen, due to various things. And even if they removed the other persons purely as a gesture of goodwill, there will have been reasoning behind it. In addition to which, one gesture of goodwill for one person does not set a precedence for every other customer getting their legitimate defaults removed.
  • Hello smithdown, it’s clear from your initial post and subsequent response from Orange you are in the wrong. You made an agreement, failed to keep up with agreement and set another agreement but paid the balance after 6 months (you have 6 months to clear a balance before it reaches a default status). I’m sure you will agree that 6 months is a long time to pay a bill. That’s half a year to pay £157. The company will have followed guidelines to review your query and quite simply, reading the emails you pasted makes it apparent your at fault. Copy and pasting someone else’s template entirely is a tad weak though. Where’s your sense of independence? No-ones situation is the same, there are multiple different reasons why a default has been removed and the letter you pasted as a response shows you clearly broke agreements. Due to this your credit file is reflecting accordingly. As Gaz said move on..

    Wait until next October and it will be gone anyway. After 6 years from the date of default it will drop off your file.

    As for your credit "score" and "rating" provided by the CRAs, take it with a massive pinch of salt.

    It may be (I don't know your credit history) that you have had no credit since that date, have no cards and a PAYG mobile phone. If that's the case, the only history lenders will see is the adverse from EE. This is as bad as no history and the big name lenders will almost always reject.

    Your best bet for now is to approach either your bank (they will know your current conduct) or one of the credit builder companies (Aqua, Barclaycard initial, Luma, Capital One or similar) and apply. You'll likely get accepted with a small limit. Spend no more than you can afford to pay back in full every month or half the credit limit (whichever is smaller) and do this every month. This will build a recent good history. After 6 months to a year, you'll be in a better position.

    Your other problem may be that you already have lots of credit in use or available and are at the limits that companies think you can pay back.

    Also have you thought that the other forum poster may have been less than honest about their response from EE?
