A few of my items didnt sell in my last auction.
If I were to use the relist on them would I pay the ebay fees, and only have them refunded if I sold the items?
I am guessing if they didnt sell the second time I would still have to pay the fees?

Yes, the relisted item must sell for you to qualify for a free relist. If the item doesn't sell the second time, then the insertion fee isn't refunded.0
