Allocated parking/right to park - FTB

Sorry for the long post but could do with some advice.

The house I am in the process of purchasing was advertised as having two allocated parking spaces, when I went to view it I was told there was actually 3 allocated spaces and on the TA6 form it says there are 3 allocated parking spaces. However, one of the other documents my solicitor has given me is a conveyance from 1983 when the house was purchased under Right to Buy from the council which says that the purchaser and his successors have the right to park one vehicle on some part of the common parking area (subject to space being available) subject to the payment of a twenty-eight share of the expense report of maintaining and keeping the whole or any part of the common area.

I can't see any mention of the parking area in any of the other documents I have so am guessing that there isn't any allocated parking but have asked my solicitor on Thursday to confirm this but waiting over the bank holiday weekend is driving me crazy.

The house is just round the corner from where I live and every time I walk past there have been spaces but I am worried about possible parking problems in the future. When looking for a house I discounted others with space for only 1 car and there isn't room to park on the street, neighbouring houses have turned their front garden into a drive but mine wouldn't be big enough to do this.

Can the council enforce the parking area to allow only one car to be parked there and is it likely that they would do so in the future?

Does the lack of allocated parking affect the value of the property?

Will this affect my mortgage valuation? The survey doesn't mention the parking at all.

Are there any other issues with common parking areas?

I love the house and really don't want to pull out as apart from the parking has everything i need but want to make sure I'm not making a big mistake.

    Well in that case is the parking really that bigger deal?

    Your solicitor should be able to answer any concerns...

    Can the council enforce the parking area to allow only one car to be parked there according to the conveyance you refer to, yes. But there may be other documentation.

    Does the lack of allocated parking affect the value of the property? yes, to some extent. You yourself "discounted others with space for only 1 car " so other buyers might do the same. Fewer buyers = lower price.

    Will this affect my mortgage valuation? The survey doesn't mention the parking at all. Doubtful.

    Are there any other issues with common parking areas? Maintenance costs?
    Introduction of clamping system?
    Residents using them for endless car repairs?

    If you can't wait for your solicitor to check, why not ask the vendors yourself to clarify? Or other residents since you'll be talking to them anyway? (You will, won't you?)
  • A similar thing happened to my sister in law, except she was only renting so I suppose it's not as much of a big deal. She was told the flat had an allocated parking space and happily parked there for the first couple of months. Then one day the owner of a neighbouring businesses put up signs and claimed the spaces actually belonged to him. She kept coming back to find his company vans parked there. However in her case there were only 5 or 6 spaces in the parking area. If you think it looks like there's lots of space it's probably OK. As long as you've got somewhere to park nearby it's probably not worth giving up a house over.
