Order hasn't arrived in shop after 2 months. What can I do?

Hi, I hope you wonderful people can help.

I tried some expensive bike shoes in a shop (about £180... they are the only ones that fit my problem feet :/) 2 months ago and decided I needed a size that wasn't in stock. I ordered it and paid my money in person (via credit card if that helps), and they said it'd be about 2 weeks. 1 month later some shoes arrived at the store but it turns out they'd ordered - or were sent - the wrong size (I have email correspondence clearly stating the size required). They then placed a new order with their supplier, but despite the shop nagging them daily there is no word from the supplier when the correct size will be dispatched.

It's now 2 months after my initial order and I want to cancel. Whilst I haven't used the words "time is of the essence" nor yet threatened to cancel the order, the correspondence shows to date that I require them pretty much this week.

The shop staff are a great bunch and I'm sure it's not their fault, but I've run out of time and patience and now buy elsewhere.

What rights do I have? Is this possible? Or do I have to remain patient and hope they get to me eventually.

    Go into the shop, tell them you want to cancel the order (given that it has now been 2 months).

    If they refuse to refund you, in full, then come back and ask.

    They are perfectly within their rights to refund the payment exactly as it was made, to the credit card.

    When you say "They are perfectly within their rights to refund the payment exactly as it was made, to the credit card" I'm not sure I follow. Did you mean to imply that *I* am within my rights to request it? Or...

    I was thinking you might not want the refund to the CC, if, for example, your CC is fully paid off, as it would put you into a positive balance.

    But they can insist on refunding to the CC, I believe, as it was the original method of payment.

    (I believe, though I am not 100% sure, it's something to do with money laundering regs, but as I say, I am not certain, so don't take my word for it!)

    In the interim, do retain all correspondence, in case you have to initiate a S75 claim.
