Freeholders insurance

Hi I bought a flat last summer leasehold maisonette with basement owned but and we were told lived in by the freeholder. Since we have been there we have seen 2 lots of tenants come and go and now a third The freeholder lives and works abroad. We receive our buildings insurance policy at completion before we knew this and it said insurance only valid if 3 named policy holders are resident and NO LETTING in capitals on page 1!! We had a leak in November and the freeholder dealt with it and claimed and did everything but we are selling now (other reasons I am ill) and I asked her if I could have a revised policy stating the flat is let and she hasn't given it. I am now worried that all the time I have lived here in insurance has been invalid.I suspect she paid for the leak herself as she doesn't want them to know its let What can I do? Is it underhand of me to contact the insurers and ask for a revised policy or to at least check we are covered? I am especially worried as the new tenants moved in this weekend and smoke and I am scared of fire and no cover!! Thanks in advance for ANY advice

    You obviously need to check you are covered so do whatever it takes to satisfy yourself on this. It might be better to write or email than phone because then you have a trail of who told you what if it all goes wrong.

    I am not sure who to ask I asked the freeholder this morning and she emailed back that she had told the insurance co she had a tenant but then I received my renewed documents and they still say we all have to be living here and no letting. I don;t want to get her into trouble but I do think she hasn't told them

    You need to cover your own back and get this clarified with your insurer.


    In the event the premises were burnt to the ground, your neighbour with the tenant won't be paying your claim if your insurer refuses because of the letting!

    Yes I do know who to ask in terms of who the insurer is! I was just hoping to be 100% before I ask the insurers thats all as I don't want the freeholder to be angry she is a tricky person. I would have thought the new policy would state that our flat was owner occupied and the other one (her's) let but it still says all 3 must be resident so i guess I need to contact the insurance co The freeholder will freak out as she told me not to

    Well you have to look after your own interests first. The freeholder should have proper insurance; that's part of what you are paying for I assume. If the freeholder freaks then quietly explain that you had asked for an updated policy stating that the flat is let and she had not provided it; so you asked the insurer for a copy as you are entitled to have one.

    Hi I am still none the wiser as the person I need to speak to is away until Wednesday. Does anyone know what Main sole occupants means on our policy and accomodation mortgaged not let??Thanks for all teh help so far I really appreciate it
