Do you not understand? You will lose in court. You have the spades AND the money. Paypal procedures are not law and cannot prevent someone taking you to court.
Either pay for the spades you have, or return them. If you go to court, you will have to do one or the other. Plus you will have the sellers costs to pay too.0 -
I'm not sure the court would agree but it's up to you if you want to risk it . . .How can the seller simply dictate terms (like the interest payment)? If that's okay to do, then surely I can say the terms of re-payment have an administration fee of £50 for 1) lost interest on money being in their account, 2) time I have to spend sorting it out, 3) Stress for the whole thing.

Don't purple spades work as well as well as green ones?
Your seller has been sloppy in responding to the PayPal claim, but that is no excuse for you to steal the guys goods which is what you are proposing to do.
Pay up, it's the right thing to do. If you don't, prepare to waste loads of time trying to defend a court case that you are almost certainly going to lose.0 -

It's not a case of if you lose in court, it's a case of you will lose.
You are making the mistake in thinking that the buyer and seller protection policies that Paypal have are there instead of statutory rights.
They aren't, they are there in addition to those rights and a buyer or seller claiming through Paypal doesn't prevent them from taking legal action at a later date.0 -
I don't know if the buyer is actually talking about literal garden spades or just using that as an example to protect their anonymity, but it any case, a small claims court is highly unlikely to make any award to either side for "hassle": they would, however, require either payment for or return of the goods you ordered. My advice is ignore any "interest" charges, pay for the items you ordered and received but not the different one, and give the seller a deadline to uplift the wrong item if they want it back.0
