Some Help Needed

Have read the newbies thread but dont think i could find what i was looking for or didnt understand it properly.

I had a parking ticket when parking at a minster baywatch site in REEL cinemas Port Talbot
i didnt use the cinema itself, i bought a ticket and the machine requires you to enter your car registration, i entered the wrong registration CU14TUR by mistake instead of CU14YUR and didnt notice until i had the parking notice and went to dispute it.

i appealed but in doing so omitted my own fault (i appealed with out doing my research) i stated that i bought the ticket entered the registration and didnt realise that id entered it incorrectly, i then stated that a quick search of their records along with viewing of the cctv cameras would show me entering the car park and buying the ticket at the time stated on the ticket along with me being one of the only cars in the car park and would mean no one would have given me the ticket etc.etc.

they cam back with a denied appeal stating that the signs show clearly that a correct registration must be on the ticket etc. so i then appealed with POPLA who sided with Minster baywatch as they stated it shows clearly in the sign the T&Cs of parking there, which i understand but this was a genuine mistake and they still got their money so am annoyed by this.

With POPLA siding with the parking company i had an email saying that a £100 parking fee applies and needs to be paid by the 21/3/2016 or theyll get the debt collectors involved.

My question really is as I appealed to POPLA and they sided with Minster Baywatch do i still ignore the letters?? or because POPLA sided with them theres more chance of me going to the small claims court?

Threating letters i can deal with but would rather not go to court due to inconvinance and the chance of loosing.

    the choices for the future are yours and are extremely simple

    1) you do as they say and pay up (I wouldnt)

    2) you ignore the debt collector letters for 6 years (I would)

    3) if they issue an MCOL you defend yourself and put your valid points to a judge who should find in your favour as mistakes do happen but nobody was defrauded (I would do this if a court claim happens)

    my opinion, you made a mistake but have not defrauded Minster Baywatch and they accepted the money for you to park there, so I would let a judge make a fair decision which I expect you would win (but there are no guarantees)

    The best solution in my opinion would be to get this in front of a judge. You made a simple human error, the PPC want £100 because of it, even though they have lost nothing.

    It is more than likely that a judge would feel that the PPC are trying to penalise you unjustly.
    You never know how far you can go until you go too far.

    in this may seem a stupid question but will any of this effect my credit score or anything like??

    only if it goes to court , they win and you do not pay , as things stand at the moment NO nothing will affect your credit score , which is after all , just a made up number by 3 credit agencies , in an attempt to get you to spend money getting a higher number , than no company sees .


    PS: 999 credit "scores" are 17 shillings and 6 pence on ebay china

    Debt collectors are just bullies that threaten, just to extort money for doing no more than sending silly letters carefully written to scare people that know no better.

    The only way you would get a bad credit report would be if it went to court, you lost (or failed to show up) and you didn't pay up. All completely under your control.

  • Slight update

    After months of not hearing anything off minster baywatch I received a letter telling me if I didn't pau the fine they'd take it further with debt collectors I ignored these letter

    Today I have received a letter from Gladstone solicitors demanding I pay the fine if not they'd take it further
    Are these the letter everyone's on about are they empty threats or the proceedings of a court order?

    Was wondering the best course of action

    Who does the "Gladstones" letter say to pay?

    If it is DRP then file. If it is Gladstones themselves then send a Part 18 to narrow the issues and to comply with the "overriding objectives of the Civil Procedure Rules."
