ICO Ruled in my favour about kensington, what do i do next

  • The FOS will not get involved unless I can get a signature from my ex as she was also on the account. The problem is that I can not locate her.

    thats bullsh1t. they do not need person of the other signatory to if your complaint or issue is valid for you in its own right. its your credit file that is affected wrongly. here may be as well, but that is incidental. the adjudicator who told you they cant deal with it is obviously a fool.

  • This was the email the FOS sent me:

    The ICO is effectively the regulator for data matters so it will be for it to ensure Kensington complies with its ruling. I would have thought once a ruling has been made Kensington would comply.

    If it didn’t then I would think you would revert to the ICO and ask it for advice on the next steps.

    From our perspective, as before, we wouldn’t be able to look into the complaint without Ms Xxxxx agreement.

    the FOS frequently make adjudications of credit file issues.

    they should also know that the ICO cant ensure a credit complies in individual cases.

    also as said you compliant is on a credit file matter personal to you, so no agreement from ms Xxxxx is needed. if she incidentally has the same issue it would be for her to raise her own complaint

    I think over there you can click the report report-40b.png at bottom of posts if you need an urgent reply and the thread/post has been missed? Think you can also alert/tag individual posters by @theirusername in a reply... i.e. if I was there you would type @fermi in a post and it sends an alert on that post to me?

    Not sure, but could be DPA issues for the spouse's info etc if they can't get her consent.
