    Quite agree : if you enter into ANY legal contract, as long as you have the capacity to contract, you have a CONTRACT, which stands, unless specific law provides for a cooling off period - eg the uninvited salesman who visits your home and persuades you to buy.

    A contract = a deal between two parties, freely entered into. How would one like it if a store was able to turn round and say - "NO, you're not going to get what you ordered as we changed our mind".

    There is nothing to complain about UNLESS you were told you COULD cancel in which case clearly that was part of your contract, even if you were only told it - as contract law doesnt require terms to be in WRITING (except of course for the exceptions like land).

    Very few vendors will offer cancellation of 'made to order' items as otherwise there would essentially be two phases to the sale - a worthless maybe-sale phase, and a truly committed-sale phase.

    That said it's going to be tougher for DFS to get their money if you're no longer a willing party to the contract - and they may prefer to take the hit of lost-profit and/or extra stockholding (in case they can sell the item to someone ever) - rather than having to drag you through the county court to get their money, which will obviously cost them. As you don't want the item, you may as well battle on with DFS trying to get them to recognise that and bite the unpalatable bullet (recognising also that YOU won't want a country court judgment against you either).

    weve done the same thing....come home after ordering and thinking on it for 24 hours and decided we dont want it....will ring them tomorrow and see what happens.....

    Well I called canceled original order but had to get the 1 sofa which isn't to bad on 3yrs interest free but I suggest u call first and see if they will cancel it all. Good luck
  • We got a sofa a few months ago from dfs (which i'm very happy with) and the salesman told us that once we signed there was no backing out as it was made to order. Fair enough really as it was made very clear.

    now ya see.....neither I nor Dh have any recollection of them making it clear we couldnt cancel the order!!! he was that desperate for us to buy it, he was filling out the paperwork before we even decided to buy it 8)


    They have refused to cancel the order, even though it was only placed 9 working hours before. He has offered to see if he can put the order on hold. He has also offered to see if someone else at some DFS somewhere in the country buys the same sofa in the same colour (luckily we ordered black :rolleyes: ) and they can have our order but they wont know till Monday!

  • I'm sure it says it on the paperwok , right where you sign BUT to be fair they rush you trhough the paperwork so quick you don't really get chance to read a lot of it til you get home!

    It does seem extreme that you can't cancel in such a short time after ordering , it's not like the factory are gonna have started it immediatley , if that were that quick it wouldn't take 2 months for delivery!
  • Ok in November i was about to move into a new apartment so after signing all contracts with them i decided it was time to search for a new sofa as this was my first home on my own. I finally decided on a sofa with DFS ... Signed the contract but while waiting for my sofa the landlord had decided to pull out giving me no choice but to call DFS and ask them to cancel my order they said that the manager needed to talk to me and they would call me back tomorrow... Now i'm worried ... Am i allowed to cancel after so long.?.. strictly speaking i haven't started paying them any money and they haven't sent me the furniture yet. If they say i have got to have it then i have no where to put it and i don't want to put it into storage because it will get damp.

    The service i received was brilliant and i wish to use DFS in the future. Do you think they will take pitty on me. :eek:

    If you order from DFS and realise within 7 days you wish to cancel because you have found the same sofa on the internet at a cheaper price, than you need to follow these steps.

    On the direct debit paper work they will have on it in small writing you have the right to cancel your direct set up with DFS within 7 days...cannot remember how it was exactly phrased, but its along the same line...

    1) Cancel your direct debit with your bank.

    2) Notify DFS you wish to cancel and that you've cancelled the direct debit they've set up with your bank, however they will tell you you cannot cancel.

    3) You might even get a phone call afew days before the sofa's get's delivered, even though you tell them at that point you have cancelled, No doubt your delivery will still arrive. And when it does, Read the paper work and DO NOT SIGN FOR THE DELIVERY.

    It worked for a family member and also a few friends...Happy days...:T

    My reply to her was:


    People learn from thier own mistakes and other peoples experience and mistakes...I have a funny feeling you work for DFS or have something to do with the company and its obvious this is the only way you can cancel with DFS. How can you be held liable when you do not have the product!!! think about it!!! I don't know about you but I certainly will not pay for something/product I do not have in my possesion!!! Would you??!! DFS use tactics and tricks to close thier deals. My family and friends used thier brains to get out of it. Please read the title...DFS Cancellation Loophole...I think you need to check your facts before you reply to my reply. I think your name says it all... Good luck learning from your own mistakes and experiences...DonB786
