IVA and compensation

Hi.
Short and sweet.
No guessing, just fact replies please as this is very important.
If you're in an IVA and you are entitled to a form of compensation, does all the money automatically go into the IVA, or does it depend on circumstances, e.g unable to work, long/short term disability etc...

  • As ever, a lot depends on the circumstances.

    Any award of under £500 should be disregarded anyway.

    If an award is made for pain and suffering then it should not be captured by the IVA, any award made for loss of income should and almost certainly will.

    If you then wish to use the award for pain and suffering to offer a settlement of the IVA then that is an option you could consider going forward.

    The speculation refers to medical negligence, so I suppose it comes under pain and suffering.
