Yes, they would be able to.
The extra SDLT would be a consequential loss from the breach of contract.
I suspect there will be a lot of arguments about whose fault it was!0 -

Just spent 30m reading through this thread. If I was the OP I'd be demanding to know exactly what the terms of the Buyers mortgage offer were and proof.
Sounds strange anyway. How would the buyers mortgagee know that the works had been done up to 'standard'. Would someone have to go round and reinspect? What criteria of assessment would they use? Just sound very odd to me but what would I know.
Didn't help that the OP fist post was confusing and the 5 posts after that rather than clarifying added further to the confusion!0
