Court Date for Failure to Notify Drivers Details

Hi all,

Hope you can help me - I feel quite worried about a potential court summons for failure to notify the police of drivers details after a speeding fine, to break it down, here's whats' happened so far

> received speeding fine in post, checked images and they were just a blur
> asked for further images via email as could not see anything in car, no reg, no colour, just lights and a blur
> took 12 days from 18th of December to 30th for them to send me the images showing it is my car
> emails back and 4th until I sent the right drivers details over email for them to use as nomination
> they didnt email back, instead sent me a notice to appear in court within approx 5 days for failure to notify as this was done over email rather than through the form
> I sent back statement with the request to provide details in the form and argued that I had already made effort to notify the court and hadn't received anything in the mean time - not attending the said court date as was contesting as not guilty
> instead as a response i just received another letter saying I have to attend on 8th of April and it has been adjourned to this date 'for the trial to take place'

I really don't want to attend, or feel its necessary considering I've made the effort trying to give them the details and even now want to do so. I emailed the police again to clarify and got this in response:

'In regards to notice reference - please note that this notice is closed on our system to be heard by a Magistrates Court. We are no longer able to deal with and advise on this offence- please deal with the summons that you have received accordingly.'

Does anyone have any suggestions on what I can do?

    First of all its not the DVLA but the Polce. By all means bury your head in the sand, don't attend,and take the six penalty points and a fine of £500-£1000.

    Why can't/won't you name who was driving.
  • My original post says that I sent the details over email as was already in conversation with police in regards to the images/ evidence.

    They didn't reply to the email with the drivers details and I have the sent email in my outbox so can also prove this
  • Sounds like you were trying to beat the system and got caught out.

    Did you really not know who was driving?

    They don't have to provide any evidence at that stage and don't have to correspond with you. So what didn't or couldn't you name the driver?

    If you can't or won't answer that question you will be found guilty.
  • I shared the drive. I could have named the driver but I wanted to be sure the evidence they had was sufficient to begin with as the images they originally sent were VERY poor quality.

    It was clearly a mistake on my part as they had them, and as soon as they sent them I replied with the drivers details back in January.

    Well you've done they driver a favour he won't get any points or a course. They have all the evidence they need to convict you, you'll get six points, a large fine and diffuculty obtaining insurance for the next five years.
  • So I dont have a chance of notifying the proper drivers details now despite my email back in January? All because I waited to see the proper photos first?

    Is there not anything I can do?

    Your original nip/172 requirement was to name the driver, sign and return it within 28 days. You didn't do it so you committed the offence.

    You're at the mercy of the courts now.
