MIL ccj claim

I too have received a ccj claim form from MIL. Collections today for £190. My fine was given on 3/12/2014 by premier parking logistics. I promptly sent them a scanned copy of my ticket and they said appeal denied as it wasn't displayed correctly the pictures they sent clearly shows my ticket on the dash. I then received another letter from a debt collector and responded in the same way. No response. I then sent another email no response. I then received a letter from MIL In July saying intention to issue a summons. My question at this point is do they have grounds as the ticket was not stuck to the window. I displayed my ticket on the dash every day for months as did over 80% of the other cars. I don't want to start a defence if I have no chance

it wasnt a fine, it was a speculative invoice from a private parking company (PPC)
nor is this a summons, as this is civil court (its an MCOL)
this has been sold to MiL collections who are acting as debt collector, not parking company
if you get a pm from HO87 take his advice as several have been beaten recently in court (see parking pranksters blogs)
post #1 of the NEWBIES sticky thread deals with court cases
plus put suitable search words into the forum search box to find other similar threads and read and follow the same advice as those people were given (only in recent months though , preferably 2016 only)
this is no longer about what happened on the day, its about legal standing of an alleged debt sold by the alleged creditor to another company
read up, learn, then fight back, especially using the info regulars will give you on this forum , pepipoo forums and by pm from HO87 if he does so

Good grief, why so negative? If you only used the one point I have left in from your post, that would be enough of a defence. Just have a search on MIL and you'll realise what a bunch of utter $*!&+*! they are. If this isn't vexatious, then nothing is.
Keep a track of every minute you spend on this, and every paper-clip used. You'll be claiming it all back due to MIL's completely unreasonable behaviour.0 -

Not unnaturally you made the mistaken assumption that you were dealing with a company that operate to social "norms" of reasonableness. Premier Parking Logistics or in fuller terms Walton Wilkins t/a Premier Parking Logistics have something of a reputation in the Midlands - Google is you friend.
MIL Collections Ltd also have a reputation - one they have gained inside of a year - for aggressive pursuit of debts they have purchased from private parking companies. Word has it that they are buying these debts for just £1 a pop and then rushing to court seeking to enforce a "debt" increasingly around the £200 mark.
Go to Pepipoo.com and use their search function (type in +MIL +Collections) to pull up the many threads there about them.
However, the very first you should do next is to log on to Moneyclaim Online using the details shown in the box on the centre right of the Particulars of Claim (you log in using the claim number - which in the case of MIL is in the format CXQZXXXX - and the password supplied). Select the option to defend the claim in full but do not submit a defence now opt to submit one later.
By doing this you will have a total of 28 days in which to formulate your defence but are not in anyway losing the opportunity to pay off the claim if you subsequently choose to do so. In simple terms, by doing as suggested you are effectively buying yourself more time in which to consider your position.
You shouldn't be under any illusions based on their form to date MIL will push this to a court hearing although they probably won't turn up on the day.
Finally, as best we know at the moment, MIL have lost every defended case heard at court and in each case have had costs awarded against them.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

If you had never appealed they would never have had your address. What a shame you now have to fight a MIL claim because you gave a rogue operator your address on a plate. Sorry but you might want to gently kick yourself for doing that which was rather like giving your details to a Nigerian email scammer, seeing as PPL did not have access to the DVLA and could NOT have got your data. You gave it to them.
Then after getting over that slight shock of realisation that you should NEVER have appealed that particular PCN, turn to addressing what needs to be done to put that error right.
As HO87 says, there are threads on here and on pepipoo forum about MIL and you can find out that you have EVERY CHANCE of winning this at a hearing. Search this forum and pepipoo forum for 'MIL champerty' which are words that should find a defence written in someone's thread already, which you can adapt to suit.
This is not a time to be talking about what happened.
