Bank charges reclaim & statute of limitations

Regarding the credit card company who are refunding charges from over 6 years ago, I am no longer a customer for their credit card. I do have a bank account with them.
I can also confirm that I am being refunded credit card charges for late payments from this closed account when I am not in current financial hardship. So whilst I recognise that it may be rare, in this instance they are showing a generous approach.0 -

Hold on. You said bank charges. You are now saying credit card charges. These are different to bank charges.I am an Independent Financial Adviser (IFA). Am I posting the wrong information in the wrong place? As I said, I'm new to all this. I applied using the same approach & standard letter to reclaim charges for both banks and bank credit cards. The company so far that has paid out is a bank who issued a credit card.0

Forget the logo in the corner. That is a credit card provider. Credit card charges are treated differently to bank charges. Bank charges are what are levied on current accounts.
The banks won the court case in 2009 about bank charges but this did not apply to credit card charges.I am an Independent Financial Adviser (IFA). Thanks for your help. Should this posting be in another section of the forum?0

No, you should have simply stated exactly what you were complaining about. The title of your thread refers to Bank charges and the responses reflected that. Now you say you were complaining about credit card charges.
Well done on your success, especially as your complaint was turned around completely in only one week…:eek:0 -
I have recently contacted the financial ombudsman re £1000’s of pounds taken by Abbey / Santander 2004 onwards and they sent a letter to the bank formulating a complaint .
I wasn’t aware of the original ability to claim charges back then and have just had a call from the bank to say that would not look at historic charges ?? Due to terminal illness household income is very low and mainly benefits so I am in severe financial hardship which was explained to the person on the phone .
In 2004 I lost my job , I opened a business that took time to get off the ground , I went through cash flow problems like most young businesses and also had to set up a payment plan through a debt management company to assist with debts . I am now debt free and when I look back and see the moneys that have been taken from me it makes me sick to my stomach . With the answer from Santander that they will NOT look at historic charges should I continue my ombudsman complaint or forget about it . I thought i was still able to get the bank to look at charges even historic . Any advice would be grateful ..0 -

Santander's response is correct. If you were in CURRENT financial hardship, then they would consider looking at it. However, they don't have to consider HISTORIC financial hardship cases. The ombudsman cannot force them to refund anything. All they can do is make sure that current financial hardship cases are considered fairly.
The banks won the court case back in 2009. Since then, its only incorrect application of charges or current financial hardship cases that get considered.I am an Independent Financial Adviser (IFA). The bizarre thing about this thread is that all the pertinent information is there to read at the beginning, yet it's still been "bumped" .0
