IVA and a tax refund

My creditors are having a meeting with my IVA company on the 10th, to see if they will agree to me getting an new IVA. I had one previously but it failed, due to me burying my head in the sand after my husband's terminal cancer diagnosis. In the meantime I've just received an unexpected refund from HMRC. Do I have to declare the money as, although I've applied, the IVA isn't in place yet? I really wanted to use the money for my husband's headstone.
