    I did some research and found the contact details of the Assistant Management Surveyor at Workman LLP who was very understanding and kindly agreed to cancel the parking charge.

    Over the last day or so they have tried to get in contact with ParkingEye but they have only just received a reply.

    The deadline for the defense is tomorrow, what would you suggest I do now? Pay the original amount as requested or continue to appeal?

    "I’ve managed to speak to Parking Eye this morning, and have an update for you. Unfortunately, due to the stage that the claim is at, Parking Eye themselves are unable to cancel the charge. However, they have now offered a reduced “without prejudice offer”. My understanding is that this means that this will no longer be going to court and the charge would be reduced down to near the original amount. I have been informed that the enforcement agency will either be in contact with either myself or you- so please let me know if they contact yourself.

    I apologise that this is not a full cancellation as hoped."

    Email ParkingEye now, with a copy of that email from the Assistant Management Surveyor at Workman LLP and ask exactly what they are 'offering' and how to make payment if agreement is reached to resolve the dispute now.

    Obviously put the court claim number and the VRN and PCN number in the email subject line and add 'without prejudice, save as to costs' as this email discussion relates to a possible offer of settlement.

    Is that 28 days plus 5 for service, since the date on the court papers? Maybe you have longer than you think?

    But as it's a long Bank Holiday now and PE are unlikely to come back today, you'd be best advised to get a defence in over the Easter weekend anyway, part of which can cite the fact there is no legitimate interest in pursuing this charge because the Assistant Management Surveyor at Workman LLP has confirmed that the landowner does not support the charge and requires it to be cancelled.

    Obviously you need more, to cover yourself...but over the Easter weekend would be OK because the court and PE won't be working.

    The issue date of the Claim Form was 22/02/2016, so yes unfortunately the deadline was 25/03/2016.

    Does the Assistant Management Surveyor have the authority to cancel the charge? I'm still hopeful she be able to contact them again on Tuesday on my behalf to cancel the charge in full.

    Just wanted to confirm, it is still worth submitting a defence online even though the deadline has passed?

    you may find it can still be submitted online at the moment if its only 2 days past the deadline, so well worth doing if it can be done, but needs to be done soon as possible

    I think something like 33 days is the absolute max, so you are cutting it fine , which I dont understand why you are delaying ?, (not having read the whole story)

    I would say by tomorrow at the latest
  • Thanks, I was hesitant to submit a defence as the online system says it gets passed to a local court as soon as you do.

    ParkingEye have told the Assistant Management Surveyor that they are willing to settle without going to court. I hope that submitting a defence does not change their willingness to settle, or mean that it MUST go to court?

    No, it never means a case must go to court, get a grip - stop being scared of a hearing which may never happen - and read other threads, you are about to throw this away by your own inaction!

    It takes months to get to a hearing and much can happen along the way - including reaching settlement or getting a case cancelled right up until outside the courtroom on the day. Get that defence in tomorrow and then faff about as much as you like trying to get it cancelled, you can make an offer 'without prejudice' by email and exchange further offers - you will have loads of options that you WILL NOT HAVE if you just don't defend!

    YOU MUST SUBMIT YOUR DEFENCE OR YOU LOSE BY DEFAULT AND YOU ARE LIABLE FOR THE LOT.

    WITH RESPECT, STOP FAFFING AND SHOW US YOUR DEFENCE DRAFT IMMEDIATELY IN THE MORNING, BASED ON THE OTHER THREADS ALREADY HERE ABOUT COURT CLAIMS - THERE ARE LOADS.
