Mighty Deals ?

I purchased a voucher in December 2014 from Mightydeals.co.uk (Mighty Deals Voucher Code: MF61C4049) for a Reclining Leather Massage Chair; on offer for £79.99 with an claimed value of £179.99 (having now seen the quality I would debate that value but that’s another matter).

On the 1st February 2015 I contacted Mighty Deals via their web site stating; “I purchased and redeemed the voucher quoted above on the 30/12/2014 and received confirmation e-mails for both actions; the item has not been delivered nor have we received any notification of an attempted delivery to date. It would appear that the voucher has now expired and the deal is no longer available. Please advise.”

The item was subsequently delivered and on February the 6th I wrote as follows;
“The Item was delivered yesterday and on unpacking today I have discovered that it is broken. The "handle" for raising/ lowering etc has been snapped off the end of the shaft; photographs are available. Please advise.”
Natalie e-mailed from Mighty Deals to say she was going to help and had been in touch with the merchant.
The merchant e-mailed requesting photographs which I supplied by reply. This is the only time the merchant has made contact.
Following further delays and lack of contact I wrote requesting a refund and received the following response from Natalie; your request (ID#1013944) has been deemed solved. Should this not be the case, or to reopen, please reply to this email.
I replied as follows; “I received the e-mail below in response to a request for a refund due to the goods being damaged and the vendor failing to respond. I replied to Natalie last Sunday with the requested information on collection and asking what arrangements have been made in regard to making a refund; I have not received any response.
In short; we waited a ridiculous time for the delivery and had to complain, then we unpacked and found damage and now I am spending my time and energy trying to obtain a refund. Please advise”

I was eventually asked to provide details of when it would be convenient to make a collection and advised that we could accommodate most week days so long as we had sufficient notice.
We were not at home on the 16th of March and had no access to e-mail; so when an email arrived at 08:42 advising of a pickup between 09:00 and 17:00 that day we didn’t see it and when the follow up came in at 10:26 (less than two hours later) saying they were sorry they missed us we didn’t see that either. I have tried reorganising without any joy.

I emailed Mighty Deals on the 27 April detailing all of the above and have a very polite response dated the 13th of May thanking me for my patience during this busy period. They have ignored every request for a refund.

I posted all of the above as a review on an internet forum on the 27th May 2015 and received a response from MD who “found my review useful” and were dealing with the merchant. They then contacted me asking for the voucher code.
That would be the voucher code that would enable them to identify the merchant; the voucher code that was / is clearly stated in my review.

I am confident that I have a claim under the sale of goods act but is that against Mighty Deals or the “merchant”; given the difficulty of contacting MD and or the merchant how should I proceed.
