Faulty Sofa

Hi
I purchased a two-piece suite which has developed a fault. The retailer has offered to provide me with an alternative as the exact suite I purchased is no longer available. I purchased a partially leather suite whereas the replacement is the same but now is full leather. However, it is basically the same suite just probably slightly better quality. Interestingly, the fault I have is with at the non-leather part which is possibly the reason why the suite has been updated and changed to a full leather suite.
This is ok in principle but the suite I purchased was on a special deal at the time (it was one that had previously been paid for but the buyers for some reason could not take delivery) although the normal price was higher. However, the current price for the full leather suite is higher than this. It appears that they will only give me what I originally paid (which I suppose is fair) but it will mean quite a large chunk needed to be paid now. It is a real shame as I would be happy with a repair and we are generally very happy with the suite and if it were not for the fault, there would be no issue.
I am wondering what my rights are and whether I can insist on them replacing the suite with the current version with maybe a nominal payment....
Does anyone have any thoughts comments or experiences with this?
Many thanks in anticipation for your time in reading this.

You cant insist, simple as that I would be down to good will on the sellers part.
It is up to the seller to choose either repair, refund or replace. He would obviously choose the cheapest.
Have you told him you would be happy with a repair, and say that you havent got the wherewithaall to pay the difference for the other suite, you never know...
Les us know how you get on.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Thank you for the message.
I am happy with a repair and I've told them this but they have told me that the they cannot repair the item as it is no longer available.
The engineer came round took a sample to try and get replacement section, but it appears that they do not make this any more and they cannot replace it. I wouldn't even mind if they replaced the small faulty section with a totally leather piece (and have told them this), but they do not want to do that, or rather they are saying they cannot do that.
I am going to try and speak to the original store.
I will keep you posted.
Matt.

How long have you had the sofa? How much do they want you to pay towards the new one? Are the any cheaper alternatives?0

As has been said, the remedy can be either a repair, replacement or refund.
If the seller has offered a replacement, then the seller must cover the costs of doing so.
Of course, it is easy for the seller to disguise that remedy as a refund, and expecting you to spend that refund in his shop.
If they do offer a refund, the it should be real money, not a credit note.
Also note that any refund can be reduced to take account of the use you have had.
When did you buy it?0 -
Might be worth checking out the company's reviews.0

I have had it almost a year..... I am reasonably happy to pay a bit towards a new one (well I don't see I have much choice)....Titch
