CP Plus was an easy one to write because they make no attempt at the statutory wording.

Yours needs you to sit down and compare your Notice to Keeper with Schedule 4 (paragraph 8 or 9) and spot the omissions.

Or, just write a shorter/vaguer version of the above without any detail as to why the documents served by the PPC are incapable of keeper liability. Just say they are if you have no time to do the simple 'spot the difference' game against Schedule 4 (it is actually easy enough).
It's not easy if you don't understand ANYTHING that's going on but are always told to contest such letters/accusations.

I just read sections 8 and 9 from here and it's way too complicated for the average person, even just to spot the omissions from the Letter of Claim.

I don't even think I have a "Notice to Keeper" letter. At least, not in those words.
  • Taken from here, how does this sound?

    Dear Sirs,

    Re: 'PCN' Ref [ref1] / [ref2]

Thank you for your letter of April 6, 2016.

First, the alleged debt is disputed and any court proceedings will be vigorously defended.

Secondly, despite the wholly inaccurate statement that the letter is 'fully compliant with the Practice Direction' it is in fact woefully defective and appears to be a deliberate attempt to mislead the recipient.

Please therefore provide a Letter Before Claim which complies with the requirements of Annex A Para 2 of the Practice Direction on Pre-action Conduct:

    http://www.justice.gov.uk/courts/pro...action_conduct

I confirm that I shall then seek advice and submit a formal Response within 30 days of receipt, as required by the Practice Direction.

Please ensure that someone does actually read and respond to this letter, providing the specific information relating to the county court claim that your client intends to make against myself as the defendant to the proposed legal proceedings. Please DO NOT send a generic FAQ letter in reply as to do so does not meet the requirements of the Practice Direction and will take this matter no further forward.

Please note, a refusal to comply with the Practice Direction will result in an immediate referral to the Solicitors Regulation Authority for breach of the Principles contained in the SRA Handbook version 8, published on 1st October 2013.

I trust this will not be necessary, and look forward to receiving a fully compliant letter before claim in due course.

    Yours faithfully

You are not comparing it to the Letter of Claim. Now, the bit you say on bold is interesting. What was the first letter they posted to the keeper, a month or two after the windscreen PCN? That is the one to dig out and compare to paragraph 8, proof-reading style (word for word).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I'm going to send the above letter (post 33) tomorrow. I don't really understand the content. Oh well :/

I'm a lady and I'm tired after starting work at 8am today...I have no time to go back over your thread trying to get info from further back. I'm off to sleep now so hopefully someone can help tomorrow.

It's just a template letter from 'debt recovery operations'. Easy to see it's computerised drivel because they say 'if we sent you this letter then... blah' but 'if we sent you that letter, then...blah blah!'

If it was a letter specially for you it would be nore specific. Ignore it, this is just a filler.

P.S. And the reason I rarely scroll back either side of midnight to read umpteen posts on one thread (or even to go back to read the first post again) is because I read and reply to up to thirty threads every evening after work so I want to see the relevant info in the recent replies or often, I move on to the next thread. I just hop around quickly, especially if it's only a thread about a debt collector series of silly letters (like these, so far) which is not desperate for a response.

I start work at my desk in a school reception office before 8am so I can only spend so long looking here whilst watching the PFA Awards or whatever is on TV at midnight.
