Used Headphones Refund

Dear all,

I wonder where I stand on this one..
I recently purchased a pair of headphones, however a large metal block splitting left/right ear buds make them unsuitable for running. Pictures on the website exclude this metal block, so product received was not as described. However, I have used them once, which contravenes the shop's returns policy.

So, would the fact the headphones were mis-sold override the shops's own returns policy, or does this make their policy redundant?

    I think you would have needed to reject the headphones as soon as it was apparent they were not as described in order to be legally entitled to a full refund. So I don't think your statutory rights will help you get a full refund.

    How are they not as described? Did they state they were suitable for running?

    As above, exactly what product did you buy and how did you buy it, eg, online or instore?

    OP says they are not what is shown in the picture, which forms part of the description.

    ^This, and it's unclear whether it was actually purchased online anyway.

    I've used Gear4music in the past and they're usually very reasonable.

    I'd suggest simply emailing them and asking them directly.

    You mean the block in this pic? Or are they a different design?

    You can remove the metal block covering the y splitter with a blade without damaging the cable, just place it in the gap and twist.

    Googling the make/model shows numerous hits (and unboxing videos) about the y splitter cover being a bit heavy.
