Need urgent help with car purchase cancelling from dealer

Hi all, first post here and I am desperately looking for some advice!

Basically last thursday I went to a dealership and saw a car, did a test drive, and everything seemed fine.
They told me to come back on Monday to finalize the purchase, which I did.
However, after having paid for the car, and paid for the tax on DVLA's website, I took the car and it had a massive mechanical problem (basically power steering pump failure) and it was impossible to drive it. (it was in fact very dangerous)

After a bit of negociation, and after confronting him to the Consumer Rights Act, the Dealer agreed to give me a refund minus some admin fees (humm well).

But my problem now is that I have filled in the V5C, and paid for the road tax. The dealer hasn't sent it to DVLA, so technically he is still the owner of the car, and just needs to get a new V5C.

However, in order to get a refund (I stupidly paid for the whole year...) DVLA asked me to send my V5C/2 and a V62 and a cover letter explaining the issue.

So what I understand is that DVLA wants me to register as the new keeper, get a refund, and then scrap me as the new keeper and give a V5C to the dealership. Is that right?

I am not from the UK although I've lived here for 5 years it's my first (horrible) experience buying a car, so I don't really understand how these things work!

I am meeting the dealer tomorrow to get my refund but I am a bit worried that because he won't be able to get a new V5C for a few weeks (and therefore realistically won't sell the car) he will start bullying me.

To be honest I don't care about losing a few hundreds for my mistakes, I just want to get this over with ASAP and move on with my life (on my safe legs).

I would be very grateful if someone can help me clarify this before I meet the guy, DVLA were not very convincing on the phone and my google searches haven't been helpful either.

    Since you don't send the V5 off the dealer does how did you register the car in your name prior to picking up the car?

    And if the problem was present on purchase why didn't you notice it on the test drive?

    And how did the dealer manage to get the V5 sent off if you had the problem straight away.

    Come on DM at least try and make things believable.

    I didn't register the car in my name, I paid the annual tax on the DVLA website, I don't really understand how this work but I assume that indeed the Seller has to send the paperwork. If you read my message maybe you would understand better.

    Again as I said, I did the test drive on Thursday and all was fine, the problem occured on monday when I tried to leave the forecourt. The tank was empty and the seller claimed that was the reason why it happened, but of course even after filling up the tank the problem still occurred.

    I don't really understand what is not believable or why I would make up such things, I am just asking advice about what happens with the V5C when a purchase is cancelled. There is no litigation the seller asked me if I wanted repair or refund and I chose refund, which he acknowledged and accepted.

    You guys are very aggressive to a first time poster in my opinion...but thanks for replying anyway.

    I can only assume that you used the V5C/2 online to tax the car. Dealer sends off the remainder of the V5 after you have signed it. Have you signed the V5 document at the bottom?
  • Hi rich, yes I filled in the V5C in the seller's office, and then we filled in the online tax on the DVLA website using the ref number on the V5C. I have the V5C/2 with me. I did sign everything yes.
