UPDATE neighbour has removed my fence, what can i do?

    I would be absolutely amazed if the OP`s neighbour was building a brick wall without a trench and footings , if he is , the man needs a slap from any burly mates the OP might have

    This neighbour relationship is over, party wall surveyor is a great idea, do I just call one and tell them and get them to come out? How do I get neighbour to pay?
    How soon do they turn up?

    Start by looking in the yellow pages/yell.com for a party wall surveyor. Consult them to confirm that your neighbour should have served notice. Then consult a local solicitor or file for an injunction yourself. This can be done very quickly, within hours. So get to it.
    However if you applied for an injunction where there were no grounds for an injunction you could be liable for costs, so don't skip out consulting an expert. If you win then you can claim costs from your neighbour since they are the ones who didn't serve notice.

    In the part of the country I am in - I have been gobsmacked at the (low) standard of some of the walls here.

    Do you know a wall with footings compared to one without money, just by looking?

  • I can see one that instantly comes to mind that snakes around the place literally like a snake:rotfl::eek:. One of the walls I've spotted recently that has had me absolutely gobsmacked....

    This is why I didn't want him to get his own useless builders in in the first place. He does cheap and nasty every time he pays. His other garden wall is also waiting to fall down because it has no footings. But its not holding up several tons if soil like this one will be. And it won't fall into my garden, so I don't care so much.
    I can state to you already, there are no footings and he will not be told that this wall is totally dangerous and impacts his extension too when it fails.

    Am onto PW surveyors will let you know if anything can be/is done.

    I'd probably wait till it was a reasonable hight, then pop out one night to see if I could carry out a controlled fall over/undermining.

    If you can collapse it by leaning or pushing, it's obviously not safe and would need to be rebuilt in a structurally sound way.

    If need be, this overnight undermining could be a recurrent issue. There may even be a grappling hook involved, or a small dog trained as a sapper.
    That sounds like a classic case of premature extrapolation.

    I would put your concerns in writing - keep a copy for yourself plus all the photos.

    It will be much easier for the insurance company to pursue him if they can show he was negligent from the start of the work.

    Good luck. When the neighbour finds out that he has to pay your PW surveyor around £1000 for commenting on a wall that costs about £300 he may well decide that he isn't going to bother and instead put a wooden fence up with concrete sections at the bottom. Outside PWA. Not the ideal retaining wall but similar worked before.

    The PW surveyor will then probably come after you for his money as you have engaged him
