Date of a Default

Does anyone know of what goes into deciding a default date on a credit file. I have a default that I partially settled with Santander. They accepted my payment and agreed that I had no more to pay. Then they registered the default date as post the date of settlement. The account was clearly in default for some years before that as their own records show. What is the criteria for setting a default date, and can I insist that they change it to when the account first went into default.

    The guidance from the Information Commissioner (ICO) says a default should be dated from 3 – 6 months after the account fell into arrears. The creditor can show that there is an arrangement in place rather than a default though if they agree a payment plan with you. The principles for recording defaults are outlined in this document:

    From what you say I think you’ve got a fair case to ask them to correct the default date. If you have any issues you can complain to the ICO and Financial Ombudsman Service (FOS).

  • I have a default from t-Mobile from the 10th September 2010.

    It as cease to appear on my credit file since n December 2015 and my score went up.

    However , i have just had a credit alert which says Lowell Portfolio have enter a default on my credit file.

    I have contacted call Experian and they advise me, it is relate to the t-mobile debt.

    Is it possible for Lowell to re-enter the debt . what can i do ?

    Typical debt recovery tactics.

    Call them and make an offer to settle the account on the condition the default is removed from your credit file completely. Ask that any arrangement is confirmed via email.

    In my experience the DCA will just want the money and be happy to remove the default on payment.

    What date has been entered in the Lowell entry is it still 15 th September 2010 is it any different coplain to them and the ico
