    I suspect that the payroll department being in Australia is not helping the situation, that sounds very odd, is your employer an Australian-owned company? Does it have a lot of UK employees? If not then there's a good chance that admin staff in Australia will not be fully clued up on UK law.

    I've emailed them again to tell them it definitely isn't right and explained in the most basic terms I can think of why it isn't. Hopefully 3rd time lucky they'll realise the mistake after I've spelled it out to them! Yeah they're an Australian company, lots of employees in the UK though.

    it may be difficult to correct the NI over payment and get the tax correct once year end occurs
  • Surely once you've got something in writing from them saying that they've paid correctly, they'd find it very difficult to claim it back later?
