Hi, I brought a 3D CAD controller on the 22nd Februaryfor £66 (inc postage). I thought I had get myself a bargain as these things are approx £90-100 brand new normally and generally go for around £40-50 second hand.
The item condition was listed as Band New. Opening it after it arrived yesterday (29th February), the box had already been unsealed and it had obviously been used previously as there it dirt in the rim of the controller and faint scratches on the base. The box actually contained the original receipt and it was purchased in 2013.
Now I was willing to pay up to £50 for a second hand one in good condition, but I am feeling a bit put out as the seller has misled bidders as they claimed it was brand new. I could actually get a brand new one on ebay for £84 as they are currently on offer.
The seller is a private seller and has No returns accepted on the listing. I understand that this is for change of mind only and I could request a return due to SNAD, but I would be willing to keep it if I could get a partial refund of £10-15. How do I go about this, do I contact the seller and then select I received an item not as described. Does this actually open a return case? Will I be able to add photo's?

Assuming you mean February, you are within the time frame for an eBay case. You can't force the seller to give you a partial, but if you want to negotiate send them a message first. Sandwich messages are best - thanks for quick delivery - insert issue - thanks for your help.
If they don't offer a settlement that you want to accept your only option is to raise a SNAD and return it for a refund.0 -

Thank you for your help. I do appreciate that I can't make them give myself a partial refund and I will probably have to send it back for a full refund. But I might as well try as quite simply I wouldn't have bid as high if I had know it wasn't brand new.
I've never had to open an ebay case before (normally stick to business sellers), so just don't want to open a case by accident trying to contact the seller and then finding I'd lost my chance to open an SNAD case.
I might be asking an idiots question but is the correct option to select Contact Seller and then I have a question about using my item or I want to send the seller a message from my Purchase History?0 -

I don't believe it makes any difference which way you wish to contact the seller. Either of the options will be fine.The bigger the bargain, the better I feel.

You should open a returns request, the seller will have the choice of offering a part refund or accepting the return at which point you should get a pre-paid label from the returns flow.
The return also allows you to add photos to demonstrate your complaint. Returns do not have any negative effect on the sellers account (as of the end of Feb).In the game of chess you can never let your adversary see your pieces0 -

I'm not sure on this one - in the past when setting up returns through the returns request system the only option has been return to seller - full refund - in some cases (usually high volume sellers) it's completely automated i.e. start the return - here is your return label send it back, bye...
I think if the OP is after a partial refund then their best bet is to contact the seller through "ask seller a question" and do it that way, the seller can then issue a partial refund through PayPal.
I've done this myself after ordering a laptop which was basically wrapped in cellophane and brown tape then stuck in the post (nothing at all to protect it from impacts), unsurprisingly it arrived with one of the hinges completely broken and the screen almost falling off as a result - messaged the seller and just said look I still want it and I can repair it myself, I'll accept a partial refund of 50% and happily keep the item or we can go through the process of me returning it, you having to relist it again as used/spares or repairs due to it being broken etc.. They agreed to the 50% refund instantly.0 -
They changed the returns flow a while back so it doesn't go straight to return for a refund, the seller gets 4 options, accept the return, refund now, offer part refund or send a message. I don't know what buyers see but they have the option to message the seller via the return. (Some sellers may have automatic options set up for returns but that's likely the very large sellers who don't want to spend time on returns).In the game of chess you can never let your adversary see your pieces0

Hi All, Thank you all for the feedback. I have opened a returns request and added my evidence. As I said I would be quite willing to keep it if I get a partial refund to reflect the second-hand prices, but I am also quite happy to return it. I haven't really got a preference. So it is it up to the seller really.0
