Spam Emails

Hi,

I recently bought some bits and pieces from Currys online and deliberately ticked the box saying that I didn't want any promotional emails from them. Since then I have had a lot of spam emails from them, sometimes several per day. There is no "Unsubscribe" button on any of the emails.

Polite "no thanks" emails have been totally ignored as have emails asking to be deleted from their mailing list. So now I have sent them an email advising them that I am going to invoice them a handling fee of £4.50 per email.

They have responded by saying that it takes 28 days to delete me from their database. They have also failed to respond to my comments about the Data Protection Act 1998 as well as my reminders as to their statutory responsibilities concerning unsolicited emails (I have definitely not given them permission to send them).

As I am continuing to get these emails and they don't appear to be taking my threat seriously I fear that the next stage is going to be legal action. Has anyone had success with similar cases via the small claims court?

    Yes it is annoying and yes make a complaint but life threatening is not and rather than jumping up and down which will get you frustrated and the person reading said emails a laugh you should address this in a calm way if you expect a decent reply.

    I'm not really jumping up and down and I really doubt I will ever be that bothered about taking them to court, it's more a matter of principle- and it certainly isn't about the money (I'd donate any money to charity anyway).

    If my Boss were to catch me laughing at a client with a complaint then I think I'd be sacked on the spot, especially if that client was reminding me of my legal obligations.

    If they're allowed to totally disregard the DPA guidelines- even if they haven't actually broken the law as such then where will it end?

    Every single email I have received from Currys has a Unsubscribe button on the bottom.

    There is a link in the Account section saying Email Communication with links to unsubscribe.

    Don't even know why you emailed them, just click the self-automatic unsubscribe button or option under My Account.

    The boxes on the Curry's site say tick if you DO want marketing emails.

    You say you ticked to say you did not. That doesn't appear to be an option...

    Op screws up and blames everyone else, then tries to charge £4.50 per email for his mistake, perhaps it was a cunning money making scam? Maybe not so daft after all.


    Op doesn't realise you have to opt in now not out.

    It was a definite "please tick if you wish to recieve further communications" button. They have even admitted that they shouldn't have been sending me the emails (but without a hint of an apology) in the email that said it will take 28 days to delete me. The first email came with an "unsubscribe" button but pressing it made no difference. It is since then they haven't had a button.

    Yup, thats what I said.

    So you deliberately ticked a box that isn't present. Are you sure you didnt misread and deliberately tick the box that said you do want emails.

    You can't charge them a fee, they haven't entered into a contract with you for email handling.

    Thats the equivalent of me sending you an invoice for £50 for having read your post on this forum.

    Oh my Lord it's an email, no need to open it just delete....
